OBSERVATION:The Spill Prevention, Control, and Countermeasure(SPCC)Plan was not implemented, as required. Monthly secondary containment tank inspections, briefing, visual tank inspections and trainings were not conducted by the facility as per their SPCC plan. REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter"SPCC Plan"or "Plan")," in accordance with § 112.7 and any other applicable section. 25270.4.5.(a):An owner or operator shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1)of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. This is a repeat violation (Class 2) Violation. 8 Code of Fed Regulations 112.5(a), 112.5(b)4030039-SPCC has been implemented within 6 months of amendment. OBSERVATION: Facility failed to implement the following SPCC plan amendment(s)within 6-months following preparation of said amendment(s): -The facility's corn oil tanks are empty since November 2021 and needs"permanently closed"signs and dates. REGULATION GUIDANCE: (a)Amend the SPCC Plan for your facility in accordance with the general requirements in § 112.7, and with any specific section of this part applicable to your facility,when there is a change in the facility design, construction, operation, or maintenance that materially affects its potential for a discharge as described in§ 112.1(b). Examples of changes that may require amendment of the Plan include, but are not limited to: commissioning or de commissioning containers; replacement, reconstruction, or movement of containers; reconstruction, replacement, or installation of piping systems; construction or demolition that might alter secondary containment structures; changes of product or service; or revision of standard operation or maintenance procedures at a facility.An amendment made under this section must be prepared within six months, and implemented as soon as possible, but not later than six months following preparation of the amendment. CORRECTIVE ACTION: Immediately implement all required SPCC plan amendments. Submit proof of correction to the EHD.
