Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />May 10, 2024 <br /> Facility Address: <br /> 8551 West Ln, STOCKTON <br /> Facility Name: <br /> STKN MUD WATER WELL #20 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 10 HSC 25508.1(a)-(f) Failed to electronically update the HMBP within 30 days of substantial change in operations. <br />OBSERVATION: During the inspection, a 55 gallon drum of used oil was found on site that was not included in the <br />hazardous material inventory. The business has not updated and submitted the information within 30 days. <br />REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br />information submitted to the California Environmental Reporting System (CERS): <br /> a) A 100 percent or more increase in the quantity of a previously disclosed material. <br /> b) Any handling of a previously undisclosed hazardous materials <br /> c) A change of business or facility address <br /> d) Change business ownership <br /> e) Change of business name <br /> f)(1) A substantial change in the handler's operations occurs that requires modification to any portion of the <br />business plan. <br /> (2) For the purpose of this subdivision, “substantial change” means any change in a facility that would inhibit <br />immediate response during an emergency by either site personnel or emergency response personnel, or that could <br />inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, <br />or impede implementation of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is a Class II violation. <br /> 12 HSC 25505(c) Failed to have the HMBP readily available to facility or EHD personnel. <br />OBSERVATION: Facility could not provide the Emergency Response Plan and the inventory information upon <br />request. Employees do not have access to the Emergency Response Plan and the inventory information on-site. <br />REGULATION GUIDANCE: The emergency response plans and procedures, the inventory of information required <br />by this article, and the site map required by this section shall be readily available to personnel of the business or the <br />unified program facility with responsibilities for emergency response or training pursuant to this section. <br />CORRECTIVE ACTION: Immediately make arrangements to have the business plan readily available for review. <br />This is a minor violation. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were 5 violations during the <br />inspection. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a <br />statement documenting the corrective actions that have been or will be taken for each violation, and any <br />supporting paperwork, by 6/9/2024. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br />($162).
