BEFORE THE BOARD OF SUPERVISORS OF THE COUNT Y OF SAN JOAQUIN <br />STATE O. CALIFORNI1 <br />• W <br />i �, i •, _.� t l'eil <br />WHEREAS, Public Resources Code, §43500 through §43610.1 and Title 27, California <br />Code of Regulations (Regulations), Division 2, Subdivision 1, Chapter 6, require operators of <br />solid waste landfills to demonstrate the availability of financial resources to conduct corrective, <br />action activities; and, <br />WHEREAS, §22228 and §22245 of the Regulations specify a Pledge of Revenue as an <br />acceptable mechanism to demonstrate financial responsibility for corrective action costs of solid <br />waste landfills; and, <br />WHEREAS, the County of San Joaquin owns the following four landfills, which are <br />operated in conformance with the findings, conditions, prohibitions, and requirements contained <br />in their Solid Waste Facilities Permits (SWFs) issued by the County of San Joaquin Department <br />of Environmental Health serving as the Local Enforcement Agency. (LEA) for the California <br />Integrated Waste Management Board (CIWMB): <br />North County Recycling Center and Sanitary 'Landitli, SWF No. 39 -AA -0022 <br />Foothill Sanitary Landfill SWF No. 39 -AA -0004 <br />Harney Lane Sanitary Landfill, SWF No. 39 -AA -0003 <br />Corral Hollow Sanitary Landfill, SWF No. 39 -AA -0005 <br />WHEREAS, the County of San Joaquin is pledging revenues from tipping fees of the <br />North County Recycling Center and Sanitary Landfill, the Foothill Sanitary Landfill, the Lovelace <br />Materials Recovery Facility and Transfer Station (Solid Waste Facility Permit 39 -AA -008), and <br />other revenue sources that the Solid Waste Enterprise Fund may have; such revenues being <br />deposited into the Solid Waste Enterprise Fund of the County of San Joaquin; and, <br />WHEREAS, the County of San Joaquin has determined that projected net revenues <br />From these sources during a hypothetical 30 -year corrective action period will be greater than <br />the corrective action costs contained in the most recent Cost Estimate for corrective action at the <br />County -owned landfills identified above, which has been submitted to the CiWMB in accordance <br />with §21840 of the Regulations; <br />NOW THEREFORE, BE IT RESOLVED, by the Board of Supervisors of -the County of <br />San Joaquin that: <br />The County of San Joaquin shall establish a Pledge of Revenue to demonstrate financial <br />responsibility for corrective action costs of the four County -owned landfills in accordance <br />with §22228 and §22245 of the Regulations. <br />
