<br />OBSERVATION: Facility failed to ensure that tanks are inspected and tested by an appropriately qualified person in
<br />accordance with industry standards. The TI-3386, Fire Pump Tank, Waste Oil Tank #1, Waste Oil Tank #2,
<br />Gasoline Tank, Motor Oil Tank #1, Motor Oil Tank #2, and Hydraulic Oil Tank were not tested/inspected on
<br />schedule. The schedule per the SPCC Plan is annually and monthly with records for the past three years.
<br />REGULATION GUIDANCE: 112.8(c)(6) Test or inspect each aboveground container for integrity on a regular
<br />schedule and whenever you make material repairs. You must determine, in accordance with industry standards, the
<br />appropriate qualifications for personnel performing tests and inspections, the frequency and type of testing and
<br />inspections, which take into account container size, configuration, and design (such as containers that are:
<br />shop-built, field-erected, skid-mounted, elevated, equipped with a liner, double-walled, or partially buried). Examples
<br />of these integrity tests include, but are not limited to: visual inspection, hydrostatic testing, radiographic testing,
<br />ultrasonic testing, acoustic emissions testing, or other systems of non-destructive testing. You must keep
<br />comparison records and you must also inspect the container's supports and foundations. In addition, you must
<br />frequently inspect the outside of the container for signs of deterioration, discharges, or accumulation of oil inside
<br />diked areas. Records of inspections and tests kept under usual and customary business practices satisfy the
<br />recordkeeping requirements of this paragraph.
<br />112.7(e) Inspections, tests, and records. Conduct inspections and tests required by this part in accordance with
<br />written procedures that you or the certifying engineer develop for the facility. You must keep these written
<br />procedures and a record of the inspections and tests, signed by the appropriate supervisor or inspector, with the
<br />SPCC Plan for a period of three years. Records of inspections and tests kept under usual and customary business
<br />practices will suffice for purposes of this paragraph.
<br />CORRECTIVE ACTION: Ensure that all tanks are inspected and tested by an appropriately qualified person in
<br />accordance with industry standards and records are kept for the past three years. Submit a statement ensuring all
<br />tanks will be inspected and tested appropriately to the EHD.
<br />This is a repeat violation, Class II.
<br /> 724 CFR 112.8(d)(4) Failed to regularly inspect aboveground valves, piping, and appurtenances.
<br />OBSERVATION: The facility failed to regularly inspect aboveground valves, piping, and appurtenances. Per
<br />manager and onsite records, inspections were not being conducted for some time prior to 2023.
<br />REGULATION GUIDANCE: (d)(4) Regularly inspect all aboveground valves, piping, and appurtenances. During the
<br />inspection, you must assess the general condition of items, such as flange joints, expansion joints, valve glands and
<br />bodies, catch pans, pipeline supports, locking of valves, and metal surfaces.
<br />CORRECTIVE ACTION: Immediately inspect all aboveground valves, piping, and appurtenances and ensure
<br />inspections are done regularly. Provide a statement of compliance going forward to the EHD.
<br />This is a Class II violation.
