I've closed #30 and #57 .
#15 : SPCC Plan addressed the type of oil and storage capacity for all fixed and portable containers.
I see that the SPCC PLAN REVIEW AND AMENDMENT LOG shows that the addition of the diesel generator was marked as
"no" for PE Certification Necessary. And the diesel generator was hand written under Table 1 . CFR 112 .6(a ) (2) states that
technical amendments should be certified by a professional engineer ( PE ). Technical amendments are "when there is a
change in the facility design, construction, operation, or maintenance that affects its potential for a discharge ..." Adding
new tanks to your facility's SPCC Plan affects the potential for discharge so this addition actually needs to be certified by
a PE. The PE would evaluate the tanks for spill prevention and control. They would review the additions and note things
in your plan like the secondary containment and discharge predictions for the tank. For example this generator may
have secondary containment built in that would be noted in the plan or the PE may note that you need to keep
absorbent near the tank in case of release. Please provide the SPCC Plan certified by a PE showing the addition of the
diesel generator.
Our office will be closed for 4tn of July and I will be off most of next week for a funeral out of town, but I can respond to
any questions you have when I return . Or if you prefer, you can call our main line and ask to speak to someone with
CUPA about an APSA inspection .
Thank you and have a safe 4th ofjulyl
All the Best,
Carol Presto
Registered Environmental Health Specialist
San Joaquin County Environmental Health Department
Email : cpresto@sigov.org I Direct: (209) 616-3061 Main : ( 209) 468-3420
https ://www.slgov. org/department/"envhealth
* NOTE* I will be out of office every other Friday:
May 100 24 1 Jun 7, 211 Jul 5, 19 1 Aug 2, 16, 30
EHD will be closed for the following holidays:
May 27 1 July 4 1 Sept 2 1 Nov 11, 280 29 1 Dec 25
From: Carole Conti <execaccounts@contimaterials.com>
Sent: Tuesday, July 2, 2024 3 :40 PM
To: Presto, Carol [EHD] <cpresto@sjgov.org>
Cc: Mike Conti <mike@contimaterials.com>; Gene Conti <gconti@contimaterials.com>
Subject: FW: 3932 Newton Rd - APSA, HW, HMBP Inspection Reports
Importance: High
1
