OBSERVATION: The facility failed to amend the Spill Prevention, Control, and Countermeasure (SPCC) Plan within six months of when there was a change in design, construction, operation, or maintenance, which affects the facility’s discharge potential. -The SPCC Plan lists AST-1 (diesel fuel) as a 10,000-gallons capacity tank, which is not longer on site. Manager Erik Sandoval stated that the tank observed on site at the time of inspection, which replaced the 10,000-gallon tank, has a storage capacity of 15,546-gallons. The exact date of installation for the tank was not confirmed by the facility. -The SPCC Plan lists the storage capacity of AST -2 (motor oil) and AST-3 (used oil) as 110-gallons each. The tanks observed on site at the time of inspection in the location of AST -2 and AST-3 as illustrated by the site map, were two 400-gallon ASTs. REGULATION GUIDANCE: (a) Amend the SPCC Plan for your facility in accordance with the general requirements in § 112.7, and with any specific section of this part applicable to your facility, when there is a change in the facility design, construction, operation, or maintenance that materially affects its potential for a discharge as described in § 112.1(b). CORRECTIVE ACTION: Ensure that the SPCC Plan has been amended, as required, and it accurately represents facility design, procedures, and policies currently in place. Provide proof of correction to the EHD. This is (Minor) Violation. 7 Code of Fed Regulations 112.5(b) 4010009 - 5 year review performed on SPCC and documented. OBSERVATION: The facility failed to perform the 5-year review of the SPCC plan. The Spill Prevention, Control, and Countermeasure (SPCC) Plan was last certified on 3/7/2019. No 5-year review statement or PE certification was completed before the 5-year review deadline of 3/7/2024. REGULATION GUIDANCE: (b) Notwithstanding compliance with paragraph [112.5] (a) of this section, complete a review and evaluation of the SPCC Plan at least once every five years from the date your facility becomes subject to this part; or, if your facility was in operation on or before August 16, 2002, five years from the date your last review was required under this part. As a result of this review and evaluation, you must amend your SPCC Plan within six months of the review to include more effective prevention and control technology if the technology has been field -proven at the time of the review and will significantly reduce the likelihood of a discharge as described in § 112.1(b) from the facility. You must implement any amendment as soon as possible , but not later than six months following preparation of any amendment. You must document your completion of the review and evaluation , and must sign a statement as to whether you will amend the Plan, either at the beginning or end of the Plan or in a log or an appendix to the Plan. The following words will suffice, “I have completed review and evaluation of the SPCC Plan for (name of facility) on (date), and will (will not) amend the Plan as a result.” CORRECTIVE ACTION: Immediately complete and document the 5-year review of the SPCC Plan and make any necessary amendments (a Professional Engineer must certify any technical amendments).
