SAN ,,] DAQ U I <br /> N Environmental Health Department <br /> C0uT IV <br /> Aboveground Petroleum Storage Act Inspection Report <br /> Facility Name: Facility Address: Date: <br /> WINDMILL COVE RESORT/MARINA LLC 7600 WINDMILL COVE RD, STOCKTON June 10, 2024 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 110 HSC 25404(e)(4) Failed to report program data in the California Environmental Reporting System (CERS). <br /> OBSERVATION:A submission to the California Environmental Reporting System (CERS)for the Aboveground <br /> Petroleum Storage Act(APSA)program has not been submitted annually.The current submittal is not accurate. <br /> 1)The facility has the 10,000 gallons gasoline tank on-site for at least 5 years,the initial APSA submittal was <br /> completed on 5/13/2024. <br /> 2)The maximum quantity of the 10,000 gallons tank listed in CERS under the chemical inventory form as 5,000 <br /> gallons.The maximum quantity cannot be less than the size of the largest container. <br /> 3)The facility listed in CERS 05/13/2024 as the date of the SPCC Plan Certification for 5-Year Review. The facility <br /> does not have a SPCC plan/has not prepared SPCC plan. <br /> REGULATION GUIDANCE: 25404(e)(4) No later than three years after the statewide information management <br /> system is established, each CUPA, PA, and regulated business shall report program data electronically. The <br /> secretary shall work with the CUPAs to develop a phase-in schedule for the electronic collection and submittal of <br /> information to be included in the statewide information management system, giving first priority to information <br /> relating to those chemicals determined by the secretary to be of greatest concern.The secretary, in making this <br /> determination shall consult with the CUPAs,the California Emergency Management Agency,the State Fire Marshal, <br /> and the boards, departments, and offices within the California Environmental Protection Agency. <br /> CORRECTIVE ACTION: Beginning January 1, 2013, all businesses are required to submit all new(or any changes <br /> to existing)Aboveground Petroleum Storage Act(APSA)information online to the CERS at <br /> http://cers.calepa.ca.gov. Be sure to include your APSA activity in the Businesses Activities section in CERS in <br /> addition to any other relevant activities and required fields. Correct CERS and submit proof of correction to the <br /> EHD. <br /> This is a minor violation. <br /> 620 CFR 112.7(f)(1) Failed to train personnel on all discharge prevention details listed in this section. <br /> OBSERVATION: It appears that the oil handling personnel were not adequately trained, as required. Site does not <br /> have SPCC plan. No Records of SPCC training on-site. Employees are unfamiliar with the SPCC Plan. No training <br /> records of: 1-The operation and maintenance of equipment to prevent discharges. 2. Discharge procedure <br /> protocols. 3.Applicable pollution control laws, rules, and regulations. 4.
