A dOAQU1N Environmental Health Department <br /> COUNTY <br /> CP22 - AST Non-Qualified Inspection Report <br /> Facility Name: Facility Address: Date: <br /> OM SCOTT&SONS/HYPONEX CORP 23390 E FLOOD RD, LINDEN Jul 10 2024 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> REGULATION GUIDANCE: (c)(2)Construct all bulk storage tank installations (except mobile refuelers and other <br /> non-transportation-related tank trucks)so that you provide a secondary means of containment for the entire capacity <br /> of the largest single container and sufficient freeboard to contain precipitation.You must ensure that diked areas are <br /> sufficiently impervious to contain discharged oil. Dikes, containment curbs, and pits are commonly employed for this <br /> purpose. You may also use an alternative system consisting of a drainage trench enclosure that must be arranged so <br /> that any discharge will terminate and be safely confined in a facility catchment basin or holding pond. <br /> CORRECTIVE ACTION: Immediately ensure that SPCC adequately discusses all applicable bulk storage containers, <br /> including compatibility with material stored and conditions of storage, and description of sized secondary containment <br /> capable of containing the largest single container and sufficient freeboard to contain precipitation. <br /> This is (Minor)Violation. <br /> 59 Code of Fed Regulations 112.7(a)(1), 112.8(c)(8)4010056-SPCC adequately describes overfill prevention methods, <br /> and devices/systems used for each container. <br /> OBSERVATION: The Spill Prevention, Control, and Countermeasure(SPCC) Plan failed to adequately describe the <br /> overfill prevention methods, including a description of the devices or systems in place for each container to prevent <br /> overfills. <br /> -The SPCC plan states that the 10,000 gallon diesel tank is gauged and ullage is calculated as part of the fueling <br /> procedure. During the inspection, I was informed there was a sensor installed per the 2018 20-year tank inspection <br /> recommendation. <br /> -The SPCC plan also states that"All other fueling on site will be monitored by a trained plant employee"but does not <br /> discuss overfill prevention methods. <br /> REGULATION GUIDANCE: 112.7 (a)(1) Include a discussion of your facility's conformance with the requirements listed <br /> in this part[§112.7]. 112.8(c)(8) Engineer or update each container installation in accordance with good engineering <br /> practice to avoid discharges. You must provide at least one of the following devices: (i) High liquid level alarms with an <br /> audible or visual signal at a constantly attended operation or surveillance station. In smaller facilities an audible air <br /> vent may suffice. (ii) High liquid level pump cutoff devices set to stop flow at a predetermined container content level. <br /> (iii) Direct audible or code signal communication between the container gauger and the pumping station. (iv) A fast <br /> response system for determining the liquid level of each bulk storage container such as digital computers,telepulse, <br /> or direct vision gauges. If you use this alternative, a person must be present to monitor gauges and the overall filling of <br /> bulk storage containers. (v)You must regularly test liquid level sensing devices to ensure proper operation. <br /> CORRECTIVE ACTION: The SPCC plan shall adequately address overfill prevention methods, including a description <br /> of the devices or systems in place for each container to prevent overfills. Provide proof of correction to the EHD. <br /> This is (Class 2)Violation. <br /> 61 Code of Fed Regulations 112.8(c)(8)(v)4030022-Liquid level sensing devices regularly tested to ensure proper <br /> operation. <br /> OBSERVATION: Liquid level sensing devices for all containers have not been tested. <br /> REGULATION GUIDANCE: (c)(8)(v)You must regularly test liquid level sensing devices to ensure proper operation. <br /> CORRECTIVE ACTION: Liquid level sensing devices must be installed in accordance with CFR 112.8 and shall be <br /> FA0005674 PR0537051 SCO01 07/10/2024 <br /> EHD Rev.12/06/2021 Page 6 of 8 CP22-AST Non-Qualified OIR <br /> 1868 E.
