OBSERVATION:The Spill Prevention, Control, and Countermeasure(SPCC)Plan failed to have the full approval of management at a level of authority to commit the necessary resources to fully implement the Plan.The management approval page was not signed by the authorized facility representative. REGULATION GUIDANCE: If you are the owner or operator of a facility subject to this part you must prepare a Plan in accordance with good engineering practices.The Plan must have the full approval of management at a level of authority to commit the necessary resources to fully implement the Plan. You must prepare the Plan in writing. If you do not follow the sequence specified in this section for the Plan,you must prepare an equivalent Plan acceptable to the Regional Administrator that meets all of the applicable requirements listed in this part, and you must supplement it with a section cross-referencing the location of requirements listed in this part and the equivalent requirements in the other prevention plan. If the Plan calls for additional facilities or procedures, methods, or equipment not yet fully operational,you must discuss these items in separate paragraphs and must explain separately the details of installation and operational start-up. CORRECTIVE ACTION: Immediately obtain required management approval for the SPCC Plan for this facility. Provide proof of correction to the EHD. This is(Minor)Violation. 30 Code of Fed Regulations 112.7(f)(1)4020001 -Training provided for op/maint of equip, discharge procedures, laws/regs, general fac ops, and SPCC. OBSERVATION: Facility failed to provide training to all oil-handling personnel regarding the contents of the SPCC plan. The facility could not provide training records at the time of the inspection. REGULATION GUIDANCE: (f)(1)At a minimum,train your oil-handling personnel in the operation and maintenance of equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and regulations; general facility operations; and,the contents of the facility SPCC Plan. CORRECTIVE ACTION: Immediately provide adequate training to all oil handling personnel and submit a copy of the training log and training content to the EHD. This is(Class 2)Violation. 32 Code of Fed Regulations 112.7(f)(3)4020002-Spill prevention briefings are conducted annually. OBSERVATION: Failure to conduct spill prevention briefing for oil-handling personnel at least once a year to assure adequate understanding of the SPCC Plan. The facility could not provide records of annual spill prevention briefings. REGULATION GUIDANCE: (f)(3)Schedule and conduct discharge prevention briefings for your oil-handling personnel at least once a year to assure adequate understanding of the SPCC Plan for that facility.
