THEREFORE, PURSUANT TO PRC SECTIONS 450009 45005, AND 45011, YOU ARE <br />ORDERED TO: <br />1. Submit to the Environmental Health Department, for review and approval, a corrective <br />action plan detailing how the site will be brought into compliance. <br />2. The contents of the corrective action plan shall include, but not be limited to: <br />a site health and safety plan, work -plan, the schedule for site work and a site drainage and <br />erosion control plan. <br />3. All site work must be done in accordance with the approved corrective action plan. <br />COMPLIANCE SCHEDULE: <br />Item No, l: Within ninety (90) days of issuance of this agreement submitthe corrective <br />action plan. The LEA will either approve or deny the corrective action plan within thirty <br />(30) days of submittal. <br />Item No. 2: Site remediation shall commence within thirty (30) days of plan approval. Complete the <br />site work in accordance with the approved corrective action plan within one hundred <br />and eighty (180) days. <br />In the event the time frames for completion of the above specified activities cannot be adhered to due to <br />adverse weather or other factors not in the control of the owner, the LEA may extend the time frames <br />based upon those specific factors provided by the owner in writing. <br />PLEASE TAKE FURTHER NOTICE THAT PURSUANT TO PRC SECTIONS 45011. 45014, <br />AND 45023. If the above actions are not completed or complied with by the specified dates, the LEA may <br />seek administrative civil penalties in an amount not to exceed five thousand dollars ($5,000) for each day <br />the violation occurs, or petition the superior court for injunctive relief to enforce this order and seek civil <br />penalties not to exceed ten thousand dollars ($10,000) per day for each violation, against any person who <br />intentionally or negligently violates any provision of applicable solid waste statute or regulation. <br />Failure to remedy the aforementioned violations) by the required date(s) <br />may result in San Joaquin <br />County and/or the California Integrated Waste Management Board (CIWMB) expending available. funds <br />to perform any cleanup, abatement, or remedial work needed to protect public health and safety or the <br />environment pursuant to PRC Section 48020. <br />If the CIWMB expends funds to perform any clean <br />up, abatement, or remedial work, the CIWMB may <br />seek repayment from responsible parties pursuant to .PRC 48020 et seq. Moreover, uiy funds so expended <br />by the CIWMB constitute a lien upon the real property owned by any responsible party that is subject to <br />the remedial action (PRC Section 48023.5). <br />Nothing in this order shall constitute or be construed as a satisfaction or release fr <br />om liability for any <br />conditions or claims arising as a result of past, current, or future operations. Notwithstanding compliance <br />with the terms of this order, the owner and operator may be required to take further actions as necessary to <br />protect public health, safety or the environment. <br />
