This disposal site poses a threat to human health, safety and the environment from
<br />chemical and physical hazards, from exposed solid and hazardous wastes. Violations
<br />were initially identified on November 20, 2003 and the property owner was notified. The
<br />same violations were again identified and documented at this site on May 18, 2004,
<br />September 28, 2005, October 31, 2006, December 6, 2007, December 12, 2008,
<br />December 9, 2009, December 30, 2010, September 15, 2011, December 8, 2011,
<br />March 23, 2012, June 28, 2012, September 20, 2012, December 28, 2012, March 19,
<br />2013, and June 21, 2013 which are:
<br />1. Title 27 CCR Section 20650 Grading of Fill Surfaces. Improper grading of fill
<br />surfaces,
<br />2. Title 27 CCR Section 20820 Drainage/Erosion Control. Improper
<br />drainage/erosion control.
<br />3. Title 27 CCR Section 20750 Site Maintenance. Abandoned autos and other
<br />solid waste on the property.
<br />A Notice of Penalty Assessment was issued to the owner/operator of the site on June
<br />28, 2012, that established a compliance schedule with a deadline. The LEA determined
<br />that the site did not comply with requirements of the Notice of Penalty Assessment.
<br />Respondent could have submitted a written request to the LEA on or before July 16,
<br />2012 for an extension of time with respect to the deadlines in the compliance
<br />schedule. Respondent failed to exercise this option within the stated period and thus
<br />the Notice became final on July 16, 2012.
<br />On July 18, 2012 Mr. Evans called the EHD and said that he will contact a consultant
<br />and will take care of his site. On September 20, 2012 the EHD staff conducted an annual
<br />inspection. The EHD was unable to contact Mr. Evans. Mr. Evans was not present. On
<br />December 28, 2012 the EHD staff conducted an annual inspection. The EHD was
<br />unable to contact Mr. Evans, Mr. Evans was not present. On January 4, 2013 the EHD
<br />received work plan from Mr. William R. Little, Advanced GeoEnvironmental Inc, on
<br />behalf of Mr. Evans. The work plan was incomplete and was rejected by the EHD. On
<br />February 11, 2013 the EHD received updated work plan from Mr. Little. On March 7,
<br />2013 the EHD had comments on work plan regarding surface debris. On March 19, 2013
<br />quarterly inspection was conducted in presence of Mr. Evans and Mr. Little where all the
<br />above issues were discussed. On April 10, 2013 Mr. Young (CalRecycle), Mrs. Ambrose
<br />(CalRecycle), Mr. McClellon (EHD), Mrs. Subbotnikova (EHD) and Mr. Little (Advanced
<br />GeoEnvironmental Inc) had a conference call and discussed that additional
<br />investigation should be done prior to developing a cap plan. On May 20, 2013 the EHD
<br />contacted Mr. Little trying to get a status report. On May 29, 2013 the EHD received an
<br />e-mail from Mr. Little stating that all the work will just be done for the cover post daily use
<br />and the final grade will be likely done in October 2013 at the request of Mr. Evans. On
<br />June 21, 2013 the EHD staff conducted an annual inspection. Mr. Evans was not
<br />present.
