The Order was issued m accordance with <br />California Public Resources Code, Division 30, Part 5, Chapter 1, Article 1, commencing <br />section 45000. The Order found that Respondent in violation of several provisions <br />Title 27 of the California Code of Regulations, specifically 20820 (improper <br />control) 20650 (inadequate grading of fill surfaces) 20750 (inadequate <br />site maintenance). The Notice and Order provided Respondent with an advisement of <br />administrative appeal rights, which respondent did not exercise. That order became <br />effective on December 14, 2008. Respondent did not comply with the Notice and Order. <br />An Administrative Penalty Order finding Respondent in violation of the <br />10, 2008 Notice and Order was issued by Envitomnental Health Department <br />on June 28, 2012 (Exhibit "A" attached hereto).The Penalty Order is authorized by and <br />issued. in compliance with Public Resources Code Section 45011. The Penalty Order <br />found that Respondent failed to remedy any of the violations found in the Notice and <br />Order and established an administrative penalty, in the amount of $190,575.00 for the <br />continuing violations. The Penalty Order provided Respondent with an <br />21 Order. <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />advisement of <br />appeal rights, which Respondent did not exercise. That order became <br />on July 165 2012. Respondent did not comply with an Administrative Penalty <br />The requirements of California Public Resources Code section 45014(c) have <br />met. The copy of the Administrative Penalty Order att <br />ached hereto as Exhibit "A." <br />Petitioner, County of San Joaquin, Environmental Health Depart <br />ment, <br />requests Judgment, in the amount of $190,575.00, in conformity with this Application. <br />It is further requested that petitioner, San Joaquin County, Environmental Health <br />Department, have and recover from respondent Richard L.
