The <br />Order was issued in accordance with California Public Resources Code, Division 30, Part 5, <br />Chapter 1, Article 1, commencing at section 45000. <br />When the property owner failed to comply with the Notice and Order, an <br />Administrative Penalty Order dated June 285 2012, was issued to and served upon the property <br />owner. The Penalty Order is authorized by and was issued in compliance with Public <br />Resources Code section 45011. The Order imposed a penalty in the amount of $190,575.00 <br />pursuant to California Public Resources Code section 45016. <br />The Penalty Order provided notice of administrative appeal rights, which the property <br />owner did not exercise. That order became effective on July 16, 2012. The property owner did <br />not comply with the Administrative Penalty Order. <br />The requirements of California Resources Code section 4514(c) have been met. A <br />certified copy of the Final Administrative Enforcement Order has been submitted to the Clerk <br />of this Corot, which constitutes sufficient showing to warrant issuance of the judgment, per <br />California Public Resources Code section 4514(c). <br />IT IS HEREBY ORDERED, ADJUDGED AND DECREED that: <br />1. Richard L. Evans, aka Mick Evans, owner of Parcel Number 249-060-10 is in <br />violation of Title 27 of the California Coda of Regulations, section 20820 (improper <br />drainage/erosion conhol), 20650 (inadequate grading of fill surfaces), 20750 (inadequate site <br />maintenance). <br />2. Richard L. Evans, alta Mick Evans, is ordered to pay judgment in the amount of <br />$190,575.00 to the County of San Joaquin, Environmental Health Department, fort <br />I CLERK'S NDGMENT <br />0' <br />hwith. <br />
