(2) For the purpose of this subdivision, "substantial change"means any change in a facility that would inhibit immediate response during an emergency by either site personnel or emergency response personnel, or that could inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, or impede implementation of the business plan. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is (Class 2)Violation. 9 CA Health and Safety Code 25508(a)(1) 1010003-Business Owner/Operator ID and Business Activities pages electronically submitted and are accurate. OBSERVATION:The Business Owner information on CERS is incorrect. Spoke to former owner Tony Romley and he stated the facility was sold to a new owner over 3 years ago, CERS still has former owner information. REGULATION GUIDANCE: This information must be current and submitted as part of the business plan. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a repeat violation (Class 2) Violation. 11 CA Health and Safety Code 25505(a)(2) 1010005-Site Map with all required content electronically submitted. OBSERVATION:The site map is incomplete. -Site map does not include emergency shut offs or Evacuation staging area. REGULATION GUIDANCE: site map that contains north orientation, adjacent streets, access and exit points, evacuation staging areas, hazardous material handling and storage areas, emergency response equipment, and, if present, loading areas, internal roads, storm and sewer drains, and emergency shutoffs, as well as additional map requirements the governing body of the unified program agency finds necessary. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. This is a repeat violation (Class 2) Violation. 14 CA Health and Safety Code 25505(a)(4) 1020002-Provided initial and annual training and maintained training records for a minimum of three years. OBSERVATION:At time of inspection, training records were not available. REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training.All employees shall be trained in safety procedures in the event of a release or threatened release of a hazardous material, including, but not limited to,familiarity with the following plans and procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment.
