The following is an itemized list of CP22 - HMBP violations that have not been addressed for JACK IN THE BOX#486 as of September 27, 2024. Open violations from July 22, 2024 inspection Violation#5-1010006-Updated within 30 days of 100%increase or new haz; change of address/owner/name; or change in ops. OBSERVATION: Spoke to former owner, Tony Romley and he stated that the business was sold over three years ago. No updates have been made on CERS to show this change in ownership. REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the information submitted to the California Environmental Reporting System (CERS): a) A 100 percent or more increase in the quantity of a previously disclosed material. b) Any handling of a previously undisclosed hazardous materials c) A change of business or facility address d)Change business ownership e)Change of business name f)(1)A substantial change in the handler's operations occurs that requires modification to any portion of the business plan. (2) For the purpose of this subdivision, "substantial change" means any change in a facility that would inhibit immediate response during an emergency by either site personnel or emergency response personnel, or that could inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility,or impede implementation of the business plan. OBSERVATION: The Business Owner information on CERS is incorrect. Spoke to former owner Tony Romley and he stated the facility was sold to a new owner over 3 years ago, CERS still has former owner information. REGULATION GUIDANCE: This information must be current and submitted as part of the business plan.
