Additionally, a 55-gallon blue plastic drum of Magrabar Silicone 10-SN was seen in the ingredients <br />area. Neither one of these hazardous materials were reported in CERS. <br />REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br />information submitted to the California Environmental Reporting System (CERS): <br />a) A 100 percent or more increase in the quantity of a previously disclosed material. <br />b) Any handling of a previously undisclosed hazardous materials <br />c) A change of business or facility address <br />d) Change business ownership <br />e) Change of business name <br />f)(1) A substantial change in the handler 's operations occurs that requires modification to any portion of the business <br />plan. (2) For the purpose of this subdivision, “substantial change” means any change in a facility that would inhibit <br />immediate response during an emergency by either site personnel or emergency response personnel, or that could <br />inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, or impede <br />implementation of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is (Class 2) Violation. <br /> 5 <br />CA Health and Safety Code 25505(a)(4) 1020002 - Provided initial and annual training and maintained training records <br />for a minimum of three years. <br />OBSERVATION: Training records for the handling of hazardous materials /spill response were not available at the time <br />of inspection. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive <br />initial and annual refresher training.
