4 <br />0 <br />1 Title 27 California Code of Regulations, section 20680(4) - Cover, section 20810 - Vector Control, <br />2 and section 20870 - Hazardous Wastes; and <br />3 WHEREAS the San Joaquin County Environmental Health Department has the authority <br />4 pursuant to Public Resources Code, sections 45000, 45005 and 45011 to order the property owner to <br />5 cease and desist any improper action, and to take corrective action to correct the aforementioned <br />6 violations following a time schedule established by San Joaquin County Environmental Health <br />7 Department for the site to be brought into compliance; <br />8 <br />9 WHEREAS the Site is a "closed" site under Title 27, California Code of Regulations <br />10 (CCR) Section 21099(a), which includes sites which as here completed all closure activities prior <br />to November 11, 1990, in accordance with any regulations in effect at the time of the last receipt <br />11 <br />12 of waste; <br />13 WHEREAS pursuant to Title 27 CCR Section 21100(d): "Closed sites for which closure <br />14 plans were not approved pursuant to Section 21099 which pose a threat to public health and <br />15 safety or the environment shall implement the provisions of these regulations as required by the <br />16 LEA;" <br />17 <br />18 WHEREAS in order for a "closed site" to presently implement the provisions of these <br />19 regulations as required by the LEA, an Enforcement Order shall be issued to the person or entity <br />20 presently having possession and control over the site; <br />21 <br />WHEREAS Zador, Ervin & Nancy, Est., Etal, are the current owners of record of the <br />22 <br />Site, and are the sole persons presently having possession and control over the Site; <br />23 <br />24 WHEREAS ongoing violations in the operation of this site have been documented by the <br />25 County of San Joaquin Environmental Health Department. Ervin and Nancy Zador, the owners, <br />26 have been notified through the annual inspection reports since December 10, 2002 of the <br />27 violations which include: <br />-3- <br />
