The items below will be discussed details below in other violations. <br />1- Monthly inspections are not conducted Monthly <br />2- Training for all oil handling personnel are not conducted annually <br />3- Drainage control plan for diked areas are not followed <br />4- Visible corrosion observed on the manifold piping and fuel piping between the ASTs and the fuel dispensers . <br />5- Observed six 55 gallons portable oil drums stored in the outside storage area; these drums according to the SPCC <br />plan should be stored inside the drum storage area. <br />REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section must <br />prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter “SPCC Plan” or <br />“Plan”),” in accordance with § 112.7 and any other applicable section. 25270.4.5.(a): An owner or operator shall <br />conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) <br />of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control <br />and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in <br />Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. <br />CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. <br />This is (Minor) Violation. <br /> 3 <br />Code of Fed Regulations 112.5(a), 112.5(b) 4010010 - Facility has amended SPCC as necessary. <br />OBSERVATION: The facility failed to amend the Spill Prevention, Control, and Countermeasure (SPCC) Plan within six <br />months of when there was a change in design, construction, operation, or maintenance, which affects the facility’s <br />discharge potential. <br />-The facility has been using a different checklist (FACILITY SAFETY/ENVIRONMENTAL CHECKLIST) for the AST <br />monthly inspection. This checklist has 17 elements and it is not included in the SPCC plan. The checklist in the <br />SPCC plan contains 22 elements for inspection. The SPCC plan has not been amended to reflect the changes. <br /> REGULATION GUIDANCE: (a) Amend the SPCC Plan for your facility in accordance with the general requirements in <br />§ 112.7, and with any specific section of this part applicable to your facility, when there is a change in the facility <br />design, construction, operation, or maintenance that materially affects its potential for a discharge as described in § <br />112.1(b). <br />CORRECTIVE ACTION: Ensure that the SPCC Plan has been amended, as required, and it accurately represents <br />facility design, procedures, and policies currently in place.
