OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan was not implemented, as required for the items below. The items below will be discussed details below in other violations. 1- Monthly inspections are not conducted Monthly 2- Training for all oil handling personnel are not conducted annually 3- Drainage control plan for diked areas are not followed 4- Visible corrosion observed on the manifold piping and fuel piping between the ASTs and the fuel dispensers . 5- Observed six 55 gallons portable oil drums stored in the outside storage area; these drums according to the SPCC plan should be stored inside the drum storage area. REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter “SPCC Plan” or “Plan”),” in accordance with § 112.7 and any other applicable section. 25270.4.5.(a): An owner or operator shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. This is (Minor) Violation. 3 Code of Fed Regulations 112.5(a), 112.5(b) 4010010 - Facility has amended SPCC as necessary. OBSERVATION: The facility failed to amend the Spill Prevention, Control, and Countermeasure (SPCC) Plan within six months of when there was a change in design, construction, operation, or maintenance, which affects the facility’s discharge potential. -The facility has been using a different checklist (FACILITY SAFETY/ENVIRONMENTAL CHECKLIST) for the AST monthly inspection. This checklist has 17 elements and it is not included in the SPCC plan. The checklist in the SPCC plan contains 22 elements for inspection. The SPCC plan has not been amended to reflect the changes. REGULATION GUIDANCE: (a) Amend the SPCC Plan for your facility in accordance with the general requirements in § 112.7, and with any specific section of this part applicable to your facility, when there is a change in the facility design, construction, operation, or maintenance that materially affects its potential for a discharge as described in § 112.1(b). CORRECTIVE ACTION: Ensure that the SPCC Plan has been amended, as required, and it accurately represents facility design, procedures, and policies currently in place. Provide proof of correction to the EHD. This is a repeat violation (Class 2) Violation. 7 Code of Fed Regulations 112.7(a)(3), 25270.4.5(a) 4010015 - SPCC contains an adequate facility diagram.
