Environmental Health Department <br />CP22 - AST Non-Qualified Inspection Report <br />Date: <br />August 21, 2024 <br /> Facility Address: <br /> 3663 Petersen RD, Stockton <br /> Facility Name: <br /> Penske Truck Leasing Co., LP <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />at least once a year to assure adequate understanding of the SPCC Plan for that facility. Conduct all required spill <br />prevention briefings. Provide compliance verification to the EHD. <br />This is (Class 2) Violation. <br />Code of Fed Regulations 112.7(a)(3)(iii) 4010027 - Facility drainage or drainage controls adequately discussed. <br />OBSERVATION: Drainage of diked area is not adequately discussed in the SPCC plan. Section 112.8(b)(1) on page <br />13 of the SPCC plan states" Drainage from diked areas is prevented with shutoff valves ." . The diked area/secondary <br />containment between the two 10,000 gallons diesel tanks that may contain any leaks/spills from the piping manifold or <br />equipment/pumps has a drainage pipe. The pipe is not equipped with shut off valves . <br />REGULATION GUIDANCE: Discharge or drainage controls such as secondary containment around containers and <br />other structures, equipment, and procedures for the control of a discharge. <br />CORRECTIVE ACTIONS: Submit documentation demonstrating that the SPCC plan adequately discussed the current <br />drainage control/procedure. <br />This is (Minor) Violation. <br /> 41 <br />Code of Fed Regulations 112.8(b)(1) 4030035 - Facility drainage adequately restrained unless conditions met. <br />OBSERVATION: Failed to adequately use valves to restrain drainage from diked storage areas. <br />-The diked area/secondary containment between the 10,000 gallons diesel tanks that may contain any leaks/spills <br />from the piping manifold or equipment/pumps has a drainage pipe. The pipe is not equipped with shut off valves . ." <br />One of the facility internal inspections forms shows that this diked area contained water with oily sheen during heir <br />pervious years inspection. It is unknown how this water was disposed of and there are no drainage logs at the time of <br />the inspections. <br />REGULATION GUIDANCE: (1) Restrain drainage from diked storage areas by valves to prevent a discharge into the <br />drainage system or facility effluent treatment system , except where facility systems are designed to control such <br />discharge. You may empty diked areas by pumps or ejectors ; however, you must manually activate these pumps or <br />ejectors and must inspect the condition of the accumulation before starting, to ensure no oil will be discharged. <br />CORRECTIVE ACTION: Immediately investigated the need to install the correct type of valves to be used for the <br />drainage of diked areas and amend the SPCC Plan as necessary. Ensure that drainage valves remain closed to <br />prevent discharge from diked areas, only use manually activated pumps to empty diked areas, and inspect the <br />condition of accumulated liquids (to ensure no oil will be discharged) prior to draining. Submit proof of correction to the <br />EHD. <br />This is (Minor) Violation. <br /> 42 <br />Code of Fed Regulations 112.7(e), 112.8(c)(6) 4010021 - Written Inspection/testing procedures kept, inspection/testing <br />records signed, kept for 3 years. <br />OBSERVATION: Facility failed to keep Monthly and Annual Inspection written records tests , signed by the appropriate <br />supervisor or inspector, with the SPCC Plan for a period of three years. <br />1- The SP001 Monthly Inspections are conducted quarterly <br />2- The Monthly Safety and Environmental Checklists for 2021, Jan-Nov 2022, Dec 23, , March 24, and June 24 were <br />not available during the inspection. <br /> 57 <br />FA0010627 PR0517463 SC001 08/21/2024 <br />EHD Rev. 12/06/2021 CP22 - AST Non-Qualified OIRPage 7 of 9 <br />1868 E.
