The following three years of submittals were made <br />on: <br />2024 Submittal- 4/27/24 (Late and Incomplete) <br />2023 Submittal- 2/18/23 (Late and Incomplete) <br />2022 Submittal- 12/02/21 <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year <br />and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the <br />annual HMBP to CERS by January 15. Additionally, make a new, FULL, submittal including all of the required <br />submittal elements (Facility Information, Hazardous Materials Inventory, and the Emergency Response/Contingency <br />Plan). <br />This is (Class 2) Violation. <br /> 4 <br />CA Health and Safety Code 25505(a)(3) 1010010 - Electronically submitted adequate response plan/procedures for <br />release/threatened release of hazmat. <br />OBSERVATION: The emergency response (ER) procedures submitted to CERS failed to list the 24-hour facility <br />Emergency Response Contacts. <br />REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a release <br />or threatened release of hazardous materials, including, but not limited to, the following: <br />- immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br />- procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment <br />- evacuation plans and procedures, including immediate notice, for the site <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br /> 12 <br />FA0011116 PR0520680 SC001 08/27/2024 <br />EHD Rev. 12/06/2021 CP22 - HMBP OIRPage 2 of 3 <br />1868 E.
