Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />May 02, 2024 <br /> Facility Address: <br /> 811 ZEPHYR ST, STOCKTON <br /> Facility Name: <br /> NIAGARA BOTTLING, LLC <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 5 HSC 25505(a)(1) Failed to electronically submit hazardous materials inventory for all reportable materials on site. <br />OBSERVATION: 9200 gallon tank liquid nitrogen, 270 gallons of propane, and 55 gallons of used oil was found on <br />site that has not been reported to CERS. <br />REGULATION GUIDANCE: Any material that meets or exceeds the reportable quantity shall be reported in the <br />facility's business plan. <br />CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, add the materials to the hazardous material inventory, and submit to the EHD for <br />approval. <br />This is a minor violation. <br /> 6 HSC 25505(a)(2) Failed to electronically submit a site map with all required content. <br />OBSERVATION: The site map was not complete. The site map is missing the location of the liquid nitrogen tank <br />and the location of the liquid nitrogen emergency shut off valves. <br />REGULATION GUIDANCE: site map that contains north orientation, adjacent streets, access and exit points, <br />evacuation staging areas, hazardous material handling and storage areas, emergency response equipment, and, if <br />present, loading areas, internal roads, storm and sewer drains, and emergency shutoffs, as well as additional map <br />requirements the governing body of the unified program agency finds necessary. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />This is a repeat violation, Class II. <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. The business plan was submitted <br />late on 1/24/2017 for the year of 2017. The plans section was not submitted for the year of 2017. The business plan <br />was submitted late on 7/25/2018 for the year of 2018. The business plan was submitted late on 11/10/2019 for the <br />year of 2019. The business plan wa submitted late on 2/15/2023 for the year of 2023. The 2024 submittal was <br />made on time. This violation has been corrected. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br />information, and submit to the EHD for approval. <br />This is a minor violation. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection.
