Wipes used to wipe down rusted metal are being disposed of on a uniform <br />hazardous waste manifests using RCRA hazardous waste code D 001 and non-RCRA under waste code 352. The <br />facility stated that metal toxicity testing had been done on the waste. The facility was not able to produce these test <br />results during the inspection. <br />REGULATION GUIDANCE: A business operator shall keep records of any hazardous waste determinations made in <br />accordance with Title 22 California Code of Regulations (CCR) section 66262.11 for at least three years from the date <br />that the waste was last sent to an on-site or off-site treatment, storage, or disposal facility. The records may include <br />Safety Data Sheets (SDS), waste test results or other hazardous waste determination documentation. <br />CORRECTIVE ACTION: Assemble the hazardous waste determination documentation for the wipe waste, maintain on <br />site and submit a copy to the San Joaquin County Environmental Health Department (EHD). If hazardous waste <br />determination documentation is not available, immediately make a hazardous waste determination and begin <br />managing the waste as specified in Title 22 CCR. Use Safety Data Sheets (SDS), waste sampling and test results or <br />other knowledge to support your hazardous waste determination. Waste testing must be done using methods <br />specified in Title 22 CCR including sections 66261.20-24. Submit a statement and supporting documentation with <br />your hazardous waste determination. Demonstrate current storage and labeling for wastes determined to be <br />hazardous wastes. Provide disposal records for wastes determined to be hazardous wastes and stored longer than <br />the number of days specified in Title 22 CCR for your hazardous waste generator status. <br />This is (Minor) Violation. <br /> 12 <br />CA Code of Regulations 66268.7(a) 3030006 - Determined land disposal restrictions for hazardous waste. <br />OBSERVATION: Wipes used to wipe down rusted objects are disposed of under a D001 waste code (see uniform <br />hazardous waste manifest 025082004JJK (4/30/2024) for an example). The waste profile for the wipes showed they <br />are subject to Land Disposal Restriction (LDR) notification forms. LDR notification forms were not found on-site. In <br />addition, the facility was not able to provide any documents during the inspection showing a determination for LDR <br />notification and proper disposal. <br />REGULATION GUIDANCE: The generator shall determine if the waste is restricted from land disposal prior to <br />transport off-site and keep complete documentation on-site for three years.
