OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan was not implemented, as required. The SPCC Plan stated the SPCC Plan would be reviewed annually and the next review was due by 10/18/2024. Reviewed was not conducted. REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter “SPCC Plan” or “Plan”),” in accordance with § 112.7 and any other applicable section. 25270.4.5.(a): An owner or operator shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. This is (Class 2) Violation. 3 Code of Fed Regulations 112.7(a)(3vi), 112.7(a4) 4010017 - SPCC contains procedures for reporting a discharge. OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan does not adequately discuss procedures for reporting a discharge. The SPCC Plan did not include the following in the reporting procedures: - date of discharge - if damages or injuries occurred - if any evacuations occurred - names of individuals/organizations that have been contacted REGULATION GUIDANCE: 112.7 (a)(4) SPCC shall have procedures to relate information on the exact address or location and phone number of the facility; the date and time of the discharge, the type of material discharged; estimates of the total quantity discharged; estimates of the quantity discharged; the source of the discharge; a description of all affected media ; the cause of the discharge; any damages or injuries caused by the discharge; actions being used to stop, remove, and mitigate the effects of the discharge ; whether an evacuation may be needed; and, the names of individuals and/or organizations who have also been contacted. CORRECTIVE ACTION: Ensure the SPCC Plan includes procedures for reporting a discharge that include all of the information in the regulation listed above. Submit proof of correction to the EHD. This is (Class 2) Violation. 20 Code of Fed Regulations 112.7(b) 4010019 - SPCC predicts direction, rate of flow, total quantity of oil that could be released from a discharge. OBSERVATION: The potential equipment failure and the resulting spill from Complete Tank Failure was not addressed in the SPCC Plan. For complete tank failure, the plan lists that direction was not applicable due to being contained in the secondary containment.
