Basic Hazardous Waste Management <br /> Module 2: Hazardous Waste Determination <br /> Hazardous Waste Determination <br /> A person who generates a waste shall determine if it is hazardous by determining if the waste: <br /> o Is excluded from regulation <br /> o Is listed <br /> o Exhibits any hazardous waste characteristics <br /> • Determinations can be made by: <br /> o Testing the waste <br /> o Generator's knowledge <br /> a Waste is any discarded material of any form (liquid, semi-solid, solid, or gaseous)that is not <br /> excluded by regulation or statute: <br /> o Relinquished (disposed of, burned or incinerated, or accumulated, stored, or treated <br /> prior to or in lieu of disposal) <br /> o Recycled (applied to land in a manner constituting disposal, used in products that are <br /> applied to land, burned to recover energy, reclaimed, or speculatively <br /> accumulated) <br /> o inherently waste-like materials when recycled (e.g., F020, F021 [with ore exception], <br /> i 022, F023, F026, and F028—all dioxin- precursor waste) <br /> o A material that poses a threat to human health and/or the environment that has been <br /> mislabeled or unlabeled for more than 10 days (i.e., 10 days from the day that the <br /> labeling deficiency was first discovered) <br /> o A material that poses a threat to human health and/or the environment contained in a <br /> deteriorated or damaged packaging for more than 96 hours <br /> s Materials that are not waste: <br /> o Industrial wastewater discharges <br /> o Nuclear byproducts <br /> o Spent sulfuric acid used to produce virgin sulfuric acid <br /> o Pulping liquors reclaimed in a pulping liquor recovery furnace <br /> o Secondary materials that are returned to the original process <br /> • Wastes that are not hazardous waste: <br /> o Infectious wastes consisting only of animal carcasses <br /> o Materials not classified as a solid waste that do not exhibit a hazardous waste <br /> characteristic <br /> o Used oil re-refining distillation bottoms used as a feedstock for asphalt <br /> o Used CFC refrigerants that are reclaimed <br /> o Solid waste from the extraction and processing of ores and minerals <br /> o Hazardous wastes generated in a tank or manufacturing process unit <br /> NATEC International, Inc.
