Environmental Health Department <br />CP22 - AST Non-Qualified Inspection Report <br />Date: <br />February 26, 2025 <br /> Facility Address: <br /> 1333 E TURNER RD, LODI <br /> Facility Name: <br /> CENTRAL VALLEY WASTE SERVICES <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter “SPCC Plan” or <br />“Plan”),” in accordance with § 112.7 and any other applicable section. 25270.4.5.(a): An owner or operator shall <br />conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) <br />of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control <br />and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in <br />Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. <br />CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. <br />This is (Class 2) Violation. <br />Code of Fed Regulations 112.5(a), 112.5(b) 4010010 - Facility has amended SPCC as necessary. <br />OBSERVATION: The facility failed to amend the Spill Prevention, Control, and Countermeasure (SPCC) Plan within six <br />months of when there was a change in design, construction, operation, or maintenance, which affects the facility’s <br />discharge potential. <br />- Section 6.7 Table 3 indicates that the District Manager is Gilbert Pineda. Whereas the remainder of the SPCC Plan <br />lists Daniel Uribe as the District Manager. According to Juanita Carlson, Gilbert has not been the District Manager <br />since approximately June 2024, which exceeds 6 months. <br />REGULATION GUIDANCE: (a) Amend the SPCC Plan for your facility in accordance with the general requirements in <br />§ 112.7, and with any specific section of this part applicable to your facility, when there is a change in the facility <br />design, construction, operation, or maintenance that materially affects its potential for a discharge as described in § <br />112.1(b). <br />CORRECTIVE ACTION: Ensure that the SPCC Plan has been amended, as required, and it accurately represents <br />facility design, procedures, and policies currently in place. Provide proof of correction to the EHD. <br />This is (Minor) Violation. <br /> 7 <br />Code of Fed Regulations 112.8(c)(2) 4030010 - Adequately sized secondary containment provided and maintained for <br />bulk storage containers. <br />OBSERVATION: The facility failed to provide and maintain secondary containment for bulk storage tank installations <br />sufficient to hold the capacity of the largest container , including adequate freeboard for precipitation. The 70 gallon <br />"portable diesel tank" was observed with insufficient secondary containment . <br />- The Secondary Containment holding the portable diesel tank was seen filled with liquid. <br />REGULATION GUIDANCE: (c)(2)Construct all bulk storage tank installations (except mobile refuelers and other <br />non-transportation-related tank trucks) so that you provide a secondary means of containment for the entire capacity <br />of the largest single container and sufficient freeboard to contain precipitation . You must ensure that diked areas are <br />sufficiently impervious to contain discharged oil . Dikes, containment curbs, and pits are commonly employed for this <br />purpose.
