Environmental Health Department CP22 - AST Non-Qualified Inspection Report Date: February 26, 2025 Facility Address: 1333 E TURNER RD, LODI Facility Name: CENTRAL VALLEY WASTE SERVICES SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR - Notice to Comply) RemarksItem # prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter “SPCC Plan” or “Plan”),” in accordance with § 112.7 and any other applicable section. 25270.4.5.(a): An owner or operator shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. This is (Class 2) Violation. Code of Fed Regulations 112.5(a), 112.5(b) 4010010 - Facility has amended SPCC as necessary. OBSERVATION: The facility failed to amend the Spill Prevention, Control, and Countermeasure (SPCC) Plan within six months of when there was a change in design, construction, operation, or maintenance, which affects the facility’s discharge potential. - Section 6.7 Table 3 indicates that the District Manager is Gilbert Pineda. Whereas the remainder of the SPCC Plan lists Daniel Uribe as the District Manager. According to Juanita Carlson, Gilbert has not been the District Manager since approximately June 2024, which exceeds 6 months. REGULATION GUIDANCE: (a) Amend the SPCC Plan for your facility in accordance with the general requirements in § 112.7, and with any specific section of this part applicable to your facility, when there is a change in the facility design, construction, operation, or maintenance that materially affects its potential for a discharge as described in § 112.1(b). CORRECTIVE ACTION: Ensure that the SPCC Plan has been amended, as required, and it accurately represents facility design, procedures, and policies currently in place. Provide proof of correction to the EHD. This is (Minor) Violation. 7 Code of Fed Regulations 112.8(c)(2) 4030010 - Adequately sized secondary containment provided and maintained for bulk storage containers. OBSERVATION: The facility failed to provide and maintain secondary containment for bulk storage tank installations sufficient to hold the capacity of the largest container , including adequate freeboard for precipitation. The 70 gallon "portable diesel tank" was observed with insufficient secondary containment . - The Secondary Containment holding the portable diesel tank was seen filled with liquid. REGULATION GUIDANCE: (c)(2)Construct all bulk storage tank installations (except mobile refuelers and other non-transportation-related tank trucks) so that you provide a secondary means of containment for the entire capacity of the largest single container and sufficient freeboard to contain precipitation . You must ensure that diked areas are sufficiently impervious to contain discharged oil . Dikes, containment curbs, and pits are commonly employed for this purpose. You may also use an alternative system consisting of a drainage trench enclosure that must be arranged so that any discharge will terminate and be safely confined in a facility catchment basin or holding pond.
