Environmental Health Department <br />CP22 - AST Non-Qualified Inspection Report <br />Date: <br />February 26, 2025 <br /> Facility Address: <br /> 1333 E TURNER RD, LODI <br /> Facility Name: <br /> CENTRAL VALLEY WASTE SERVICES <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />CA Health and Safety Code 25270.6(a) 4010032 - Tank Facility Statement or Business Plan has been submitted . <br />OBSERVATION: A complete tank facility statement or a business plan was submitted late for 2024. <br />- An annual submittal for 2024 was made on 3/29/2024, 73 days late. <br />REGULATION GUIDANCE: (a)(1) On or before January 15, annually, each owner or operator of a tank facility subject <br />to this chapter shall file with the statewide information management system, a tank facility statement that shall <br />identify the name and address of the tank facility, a contact person for the tank facility, the total storage capacity of <br />the tank facility, and the location and contents of each petroleum storage tank that exceeds 10,000 gallons in storage <br />capacity. A copy of a statement submitted previously pursuant to this section may be submitted in lieu of a new tank <br />facility statement if no new or used storage tanks have been added to the facility or if no significant modifications have <br />been made. For purposes of this section, a significant modification includes, but is not limited to, altering existing <br />storage tanks or changing spill prevention or containment methods. (2) Notwithstanding paragraph (1), an owner or <br />operator of a tank facility that submits a business plan, as defined in subdivision (d) of Section 25501 , to the <br />statewide information management system and that complies with Sections 25503 , 25505 , 25505.1 , 25507 , <br />25507.2 , 25508 , 25508.1 , and 25508.2 , satisfies the requirement in paragraph (1) to file a tank facility statement. <br />CORRECTIVE ACTION: A completed business plan was submitted on time for 2025, no further action needed. Ensure <br />all future annual submittals are complete by the due date. <br />This was corrected on site. <br />This is (Class 2) Violation. <br /> 74 <br />Code of Fed Regulations 112.20(e) 4010044 - Substantial Harm Criteria certification maintained at the facility as <br />required. <br />OBSERVATION: The facility failed to complete and maintain (at the facility) the Substantial Harm Criteria certification <br />form. <br />REGULATION GUIDANCE: (e) If the owner or operator of a facility determines pursuant to paragraph (a)(2) of this <br />section that the facility could not, because of its location, reasonably be expected to cause substantial harm to the <br />environment by discharging oil into or on the navigable waters or adjoining shorelines, the owner or operator shall <br />complete and maintain at the facility the certification form contained in appendix C to this part and, in the event an <br />alternative formula that is comparable to one contained in appendix C to this part is used to evaluate the criterion in <br />paragraph (f)(1)(ii)(B) or (f)(1)(ii)(C) of this section, the owner or operator shall attach documentation to the certification <br />form that demonstrates the reliability and analytical soundness of the comparable formula and shall notify the Regional <br />Administrator in writing that an alternative formula was used. <br />CORRECTIVE ACTION: The Certification of the Applicability of the Substantial Harm Criteria was completed and <br />signed by District Manager Daniel Uribe and is now maintained on site, no further action needed. <br />This was corrected on site. <br />This is (Minor) Violation. <br /> 78 <br />Overall Inspection Comments: <br />FA0005630 PR0528795 SC001 02/26/2025 <br />EHD Rev. 12/06/2021 CP22 - AST Non-Qualified OIRPage 8 of 9 <br />1868 E.
