The business plan was last submitted late on <br />8/10/23. The submittals for the years 2024 and 2022 were not submitted. <br />REGULATION GUIDANCE: The hazardous materials business plan shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year <br />CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the <br />annual HMBP to CERS by January 15. <br />This is a repeat violation (Class 2) Violation. <br /> 4 <br />CA Health and Safety Code 25505(a)(4) 1020002 - Provided initial and annual training and maintained training records <br />for a minimum of three years. <br />OBSERVATION: The facility only had annual training for the year of 2021. Missing training for the years 2024, 2023 <br />and 2022. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive <br />initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or <br />threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and <br />procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the <br />unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential <br />harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate <br />notice, for the business site.
