Environmental Health Department <br />CP22 - HMBP Inspection Report <br />Date: <br />November 25, 2024 <br /> Facility Address: <br /> , <br /> Facility Name: <br />U.S.PAINTS <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />-Immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br />-Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment <br />-Evacuation plans and procedures, including immediate notice, for the site <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />This is (Class 2) Violation. <br />CA Health and Safety Code 25505(a)(4) 1020001 - Established and electronically submitted adequate training <br />program. <br />OBSERVATION: No training program has been submitted to CERS. <br />REGULATION GUIDANCE: Training programs for all employees and annual training, including refresher courses, shall <br />include familiarity with the facility's Emergency response plans and procedures in the event of a release or threatened <br />release of a hazardous material. Training shall cover, but not limited to, all of the following: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program <br />agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />These training programs may take into consideration the position of each employee. <br />CORRECTIVE ACTION: Immediately prepare or update the facility's training program, log into the California <br />Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and <br />submit to the EHD for approval. <br />This is (Class 2) Violation. <br /> 13 <br />CA Health and Safety Code 25505(a)(4) 1020002 - Provided initial and annual training and maintained training records <br />for a minimum of three years. <br />OBSERVATION: No training records were observed on site at the time of inspection. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive <br />initial and annual refresher training.
