OBSERVATION:The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS)annually by the due date, January 15. -An annual submittal for 2025 has NOT been made as of February 3, 2025. REGULATION GUIDANCE:The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is(Class 2)Violation. 9 CA Health and Safety Code 25508(a)(1) 1010003-Business Owner/Operator ID and Business Activities pages electronically submitted and are accurate. OBSERVATION: The Business Activities form was not current,for the following reasons: -The facility has indicated YES to meeting the requirements of the Aboveground Petroleum Storage Act (APSA) question, based on todays inspection the facility does NOT meet the requirements of APSA. This is due to the fact that the tanks harboring petroleum do not equal or exceed 55 gallons. The only material with petroleum that meet or exceed the 55 gallon threshold is"Engine Oil"which totals 660 gallons,which is below the 1320 gallons of petroleum requirement for APSA. -Christopher McCulley from Enchanted Rock indicated that oil changes are done every 750 hours on the machinery, resulting in used oil. Thus, the facility is a Hazardous Waste generator and must indicate YES to the question in the "Business Activities"page regarding the generation of hazardous waste. REGULATION GUIDANCE: This information must be current and submitted as part of the business plan. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval.The facility must indicate"No"for the APSA question in Business Activities and "Yes"to the question about the facility generating Hazardous Waste.
