The following is an itemized list of CP22 - HMBP violations that have not been <br /> addressed for Enchanted Rock, LLC - Lodi DWR Site as of July 21, 2025. <br /> Open violations from February 03, 2025 inspection <br /> Violation#4-1010008-Business plan reviewed and electronically certified as complete/accurate on or <br /> before the due date. <br /> OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental <br /> Reporting System (CERS)annually by the due date,January 15. <br /> -An annual submittal for 2025 has NOT been made as of February 3, 2025. <br /> REGULATION GUIDANCE:The hazardous materials inventory shall be submitted by January 15 of each calendar year <br /> and may be submitted beginning November 1 of the previous year. <br /> CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br /> information, and submit to the EHD for approval. <br /> ® This violation was corrected ❑This violation will be corrected by(date): <br /> ® Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#9-1010003-Business Owner/Operator ID and Business Activities pages electronically submitted <br /> and are accurate. <br /> OBSERVATION: The Business Activities form was not current,for the following reasons: <br /> -The facility has indicated YES to meeting the requirements of the Aboveground Petroleum Storage Act (APSA) <br /> question, based on todays inspection the facility does NOT meet the requirements of APSA.This is due to the fact <br /> that the tanks harboring petroleum do not equal or exceed 55 gallons.The only material with petroleum that meet or <br /> exceed the 55 gallon threshold is"Engine Oil'which totals 660 gallons,which is below the 1320 gallons of petroleum <br /> requirement for APSA. <br /> -Christopher McCulley from Enchanted Rock indicated that oil changes are done every 750 hours on the machinery, <br /> resulting in used oil.Thus, the facility is a Hazardous Waste generator and must indicate YES to the question in the <br /> "Business Activities" page regarding the generation of hazardous waste. <br /> REGULATION GUIDANCE: This information must be current and submitted as part of the business plan. <br /> CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at <br /> http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval.
