(2) For the purpose of this subdivision, "substantial change" means any change in <br />a facility that would inhibit immediate response during an emergency by either site personnel or emergency response <br />personnel, or that could inhibit the handler's ability to comply with Section 25507 , change the operational <br />knowledge of the facility, or impede implementation of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is (Class 2) Violation. <br />9 <br />CA Health and Safety Code 25508(a)(1) 1010003 - Business Owner/Operator ID and Business Activities pages <br />electronically submitted and are accurate. <br />OBSERVATION: The Business Owner/Operator Identification form was not submitted or complete. The Business <br />owner/ operator page has not been updated since 2018. Business owner, primary contact, secondary contact, <br />environmental contact, and billing contact all need to be updated in CERS. <br />REGULATION GUIDANCE: This information must be current and submitted as part of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is (Minor) Violation. <br />14 <br />CA Health and Safety Code 25505(a)(4) 1020002 - Provided initial and annual training and maintained training records <br />for a minimum of three years. <br />OBSERVATION: Employee training records were unavailable for review at time of inspection. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive <br />initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or <br />threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and <br />procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the <br />unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential <br />harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate <br />notice, for the business site. This training shall be documented electronically or by hard copy and shall be made <br />available for a minimum of three years. <br />CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br />training records to the EHD. <br />This is (Minor) Violation. <br />Overall Inspection Comments: <br />Routine HMBP Inspection. Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were 5 <br />violation found during the inspection.
