The business plan was submitted late on 2/21/203 <br />for the year of 2023. The business plan was submitted late on 3/15/2024 for the year of 2024. The business plan was <br />not submitted for the year of 2025. <br /> REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br /> CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the <br />annual HMBP to CERS by January 15. <br />This is (Class 2) Violation. <br /> 4 <br />CA Health and Safety Code 25505(a)(3) 1010010 - Electronically submitted adequate response plan/procedures for <br />release/threatened release of hazmat. <br />OBSERVATION: The emergency response(ER) procedures were not complete. The local Unified Program Agency <br />(UPA) phone number was not provide on line C1. Add 209-468-3420 as the local UPA phone number . <br />REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a release <br />or threatened release of hazardous materials, including, but not limited to, the following: - immediate notification of <br />local emergency personnel and the Environmental Health Department (EHD) - procedures for the mitigation of a <br />release or threatened release to minimize any potential harm or damage to persons, property, or the environment - <br />evacuation plans and procedures, including immediate notice, for the site. <br /> CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />This is (Class 2) Violation. <br /> 12 <br />Overall Inspection Comments: <br />Routine HMBP Inspection. Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were 2 <br />violations found during the inspection.
