In implementing the <br />SPCC plan, an owner or operator shall fully comply with the latest version of the regulations contained in Part 112 <br />(commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of CFR. <br />CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. <br />This is (Minor) Violation. <br />Code of Fed Regulations 112.5(a), 112.5(b) 4010010 - Facility has amended SPCC as necessary. <br />OBSERVATION: The facility failed to amend the Spill Prevention, Control, and Countermeasure (SPCC) Plan within six <br />months of when there was a change in design, construction, operation, or maintenance, which affects the facility’s <br />discharge potential. <br />-The convenience store hours where the SPCC Plan is stored are inaccurate. The SPCC Plan states that the store is <br />open 24-hours and site security is maintained by 24/7 constant surveillance by Facility Manager and subordinate <br />personnel. Staff on site during the inspection stated that the store has never been open 24 hours per day. <br />REGULATION GUIDANCE: (a) Amend the SPCC Plan for your facility in accordance with the general requirements in <br />§ 112.7, and with any specific section of this part applicable to your facility, when there is a change in the facility <br />design, construction, operation, or maintenance that materially affects its potential for a discharge as described in § <br />112.1(b). <br />CORRECTIVE ACTION: Ensure that the SPCC Plan has been amended, as required, and it accurately represents <br />facility design, procedures, and policies currently in place. Provide proof of correction to the EHD. <br />This is a repeat violation (Class 2) Violation. <br /> 7 <br />Code of Fed Regulations 112.7 4010012 - SPCC in writing, follows code seq/cross ref, good eng practice, mgt <br />approval, items not in place. <br />OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan failed to have the full approval of <br />management at a level of authority to commit the necessary resources to fully implement the Plan. <br />-Management Approval section was not signed . <br />-Cross-reference table inaccurately lists the page location in SPCC Plan of multiple items as "entire". <br />REGULATION GUIDANCE: If you are the owner or operator of a facility subject to this part you must prepare a Plan in <br />accordance with good engineering practices. The Plan must have the full approval of management at a level of <br />authority to commit the necessary resources to fully implement the Plan. You must prepare the Plan in writing . If you <br />do not follow the sequence specified in this section for the Plan, you must prepare an equivalent Plan acceptable to <br />the Regional Administrator that meets all of the applicable requirements listed in this part , and you must supplement it <br />with a section cross-referencing the location of requirements listed in this part and the equivalent requirements in the <br />other prevention plan. If the Plan calls for additional facilities or procedures, methods, or equipment not yet fully <br />operational, you must discuss these items in separate paragraphs and must explain separately the details of <br />installation and operational start-up. <br />CORRECTIVE ACTION: Immediately obtain required management approval for the SPCC Plan for this facility.
