OBSERVATION: Facility could not provide the Emergency Response Plan and the inventory information upon request./Employees do not have access to the Emergency Response Plan and the inventory information on-site. REGULATION GUIDANCE:The emergency response plans and procedures,the inventory of information required by this article, and the site map required by this section shall be readily available to personnel of the business or the unified program facility with responsibilities for emergency response or training pursuant to this section. CORRECTIVE ACTION: Tiberio Cardoso made a copy of inspectors copy of the Inventory and Emergency Response Contingency Plan. No further action needed. This was corrected on site. This is(Minor)Violation. 5 CA Health and Safety Code 25508.1(a)-(f) 1010006- Updated within 30 days of 100% increase or new haz; change of address/owner/name; or change in ops. OBSERVATION: During the inspection, Tiberio Cardoso stated that Joe Nyiradi has not been employed by the facility within the past 6 months. Joe Nyiradi is currently listed as the"Secondary Emergency Contact"in CERS and is listed as the"Alternate Emergency Coordinator" in the Emergency Response Contingency Plan. The business has not updated and submitted the information within 30 days. REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the information submitted to the California Environmental Reporting System (CERS): a) A 100 percent or more increase in the quantity of a previously disclosed material. b) Any handling of a previously undisclosed hazardous materials c) A change of business or facility address d)Change business ownership e)Change of business name f)(1)A substantial change in the handler's operations occurs that requires modification to any portion of the business plan. (2) For the purpose of this subdivision, "substantial change"means any change in a facility that would inhibit immediate response during an emergency by either site personnel or emergency response personnel, or that could inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, or impede implementation of the business plan.
