Tracy Blvd - UST CR Report 2024 - 12-9-24.pdf <br />Importance:High <br />Hello Mr. Khan, <br /> <br />I am writing to inform you that this facility has been operating the underground storage tanks (USTs) without a San <br />Joaquin County Environmental Health Department permit since January 2024. On December 9, 2024, a Class I violation <br />was issued to your facility for unpaid 2024 permit to operate fees (report attached). According to our records, you have <br />been operating this facility since January 2024, and the 2024 annual permit to operate fees have not been paid. <br /> <br />According to Health and Safety Code (HSC) 25284, "no person may own or operate an underground storage tank unless a <br />permit for its operation has been issued by the local agency to the owner or operator of the unified program facility on <br />which the tank is located". Also, according CCR 2711(d), " Owners and operators shall pay all applicable local government <br />and state surcharge fees." Due to the unpaid fees, this facility's 2024 permit has not been issued, resulting in a non- <br />compliant status. <br /> <br />Please be advised, since the previous tank owner/operator did not pay the 2024 permit fees, the full annual UST permit <br />fees and all associated state surcharges are due; as such, the full permit fee applies to this tank facility even if you only <br />operated at this location from sometime in January 2024 through December 2024. Failure to submit your required permit <br />fees may result in enforcement action, per the HSC Section 25299 (a), which stipulates penalties not greater than $5,000 <br />for each underground storage tank, for each day of violation, for operating an underground tank system that has not been <br />issued a permit. <br /> <br />Thank you for your attention to this matter.
