3 <br />According to Health and Safety Code (HSC) 25284, "no person may own or operate an underground <br />storage tank unless a permit for its operation has been issued by the local agency to the owner or operator <br />of the unified program facility on which the tank is located". Also, according CCR 2711(d), " Owners and <br />operators shall pay all applicable local government and state surcharge fees." Due to the unpaid fees, this <br />facility's 2024 permit has not been issued, resulting in a non-compliant status. <br /> <br />Please be advised, since the previous tank owner/operator did not pay the 2024 permit fees, the full annual <br />UST permit fees and all associated state surcharges are due; as such, the full permit fee applies to this tank <br />facility even if you only operated at this location from sometime in January 2024 through December 2024. <br />Failure to submit your required permit fees may result in enforcement action, per the HSC Section 25299 <br />(a), which stipulates penalties not greater than $5,000 for each underground storage tank, for each day of <br />violation, for operating an underground tank system that has not been issued a permit. <br /> <br />Thank you for your attention to this matter.
