If applicable, the Governor or the Legislature terminates the state of <br /> emergency pursuant to California Government Code section 8629;or <br /> b. The Central Valley Water Board terminates enrollment of individual dischargers/Units, <br /> or all Dischargers/Units temporarily enrolled under the Conditional Waiver for a <br /> particular emergency,or terminates this Conditional Waiver in its entirety,-or <br /> c. Ifopplicable,six(6)months have elapsed since the Governor issued a proclamation of <br /> the state of emergency in question;or <br /> d. Six(6)months have elapsed since emergency activities began. <br /> Forward Landfill will complete a Notice of Termination in accordance with the <br /> conditions described above. <br /> 4. Any previously-proclaimed states ofemergency either ongoing or in effect at the time ofthis <br /> Order's adoption, and far which Notices of Enrollment have already been issued by the <br /> Executive Officer under Order No.RS-2013-0026,shall be automatically enrolled under this <br /> Conditional Waiver, and remain enrolled until the occurrence ofany one of the conditions in set <br /> forth in Section A.3 herein. (This Conditional Waiver shall not be construed as otherwise <br /> extending any enrollments beyond their respective points of expiration under Section A.3 of <br /> Order No. RS-20130026.) <br /> Forward Landfill submitted a notice of intent for Wastes from a Declared Disaster Area to <br /> the Central Valley Regional Water quality Control Board on October 20,2021.This notice <br /> serves as an extension of the previous Notice of Enrollment ongoing or in effect under <br /> Order No.R5-2013-0026. <br /> S. Emergency/disaster related waste management and cleanup activities must minimize or <br /> eliminate the discharge of any pollutants that could adversely affect the quality or beneficial <br /> uses of the waters of the state. <br /> Forward Landfill will dispose of all waste streams in composite-lined,Class II waste <br /> management units designed with leachate collection system. <br /> 6. The Discharger shall prevent the direct orindirect discharge ofemergency/disaster related <br /> wastes to any surface waters of the state(including ephemeral streams and vernal pools). <br /> Forward Landfill will utilize Best Management Practices to prevent the direct and indirect <br /> discharge of emergency/disaster related wastes to any surface waters of the state, <br /> including ephemeral streams and vernal pools. <br /> 7. Emergency/disaster related waste management operations shollnot beperformed in a manner <br /> that creates, or contributes, to a condition ofpollution or nuisance. <br /> All waste management operations will be performed in accordance with applicable <br /> regulations and existing permits and plans,including but not limited to the following: <br /> • Solid Waste Facility Permit 39-AA-0015(July 16,2021) <br /> • Joint Technical Document(April 25,2018) <br /> • Odor Control Best Management Practices Program(26 May 2017) <br /> • Stormwater Pollution Prevention Plan(8 September 2015) <br /> 2 <br />
