Forward Landfill 7 15 August 2023 <br /> GeoTracker No : L10008827999 <br /> (d) General--A discharger required pursuant to § 20385 to establish a corrective action <br /> program for a Unit shall, at a minimum, comply with the requirements of this section <br /> for that Unit. <br /> (e) Standards-- The discharger shall take corrective action to achieve the following goals: <br /> to remediate releases from the Unit; to ensure that the discharger achieves <br /> compliance with the Water Standard adopted under § 203902 for that Unit. The <br /> RWQCB shall specify the Water Standard for corrective action [including any <br /> concentration limits greater than background, under § 20400(c-g)] in the WDRs . <br /> (t) Scope of Actions-- The discharger shall implement corrective action measures that <br /> ensure that COCs achieve their respective concentration limits at all Monitoring <br /> Points and throughout the zone affected by the release, including any portions <br /> thereof that extend beyond the facility boundary, by removing the waste constituents <br /> or treating them in place . The discharger shall take other action approved by the <br /> RWQCB to prevent noncompliance with those limits due to a continued or <br /> subsequent release from the Unit, including but not limited to, source control. <br /> (g) Terminating Measures-- Corrective action measures taken pursuant to %(c) (e . g. , <br /> pumping and treatment of ground water) may be terminated when the discharger <br /> demonstrates to the satisfaction of the RWQCB that the concentrations of all COCs <br /> are reduced to levels below their respective concentration limits throughout the entire <br /> zone affected by the release . <br /> The Discharger has yet to meet Title 27 ' s standards for facilities that are in corrective action . <br /> The Central Valley Water Board cannot entertain monitored natural attenuation due to the <br /> extensive contamination in multiple aquifer zones and impacted drinking water wells along <br /> Newcastle Road , the CDCR Prison (see the 2008 CAO for specifics) , as well along Austin <br /> Road . The aquifer' s beneficial uses cannot be characterized as successfully restored until <br /> wellhead treatment is no longer necessary . <br /> The Discharger cited the 2016 Water Quality Control Plan for the Sacramento River Basin and <br /> San Joaquin River Basin ( Basin Plan) in their reasoning for changing the cleanup goal . Central <br /> Valley Water Board staff dispute the report' s statement that : "At a minimum, ground waters <br /> designated for use as domestic or municipal supply shall not contain concentrations of chemical <br /> constituents in excess of the maximum contaminant levels specified in the following provisions <br /> of Title 22 of the California Code of Regulations, which are incorporated by reference into this <br /> plan (RWQCB 2016) . For groundwater downgradient of the POC that has been affected by only <br /> the release of VOCs from the Austin Road Unit, the beneficial uses as domestic or municipal <br /> supply will be restored when VOC concentrations are less than the maximum <br /> contaminant levels (MCLs), as specified by 22 California Code of Regulations (CCR) section <br /> 64444. " ( Emphasis added . ) <br /> To clarify , according to the 2019 Central Valley Water Board ' s Basin Plan "unless otherwise <br /> designated by the Regional Water Board, all ground waters in the Region are considered as <br /> 2 CCR Title 27 Section 20390 — Water Quality Protection Standard : Components & Duration - For each Unit, the <br /> RWQCB shall establish a water quality protection standard (Water Standard ) in the WDRs . This Water Standard shall <br /> consist of the list of constituents of concern ( under § 20395) , the concentration limits (under § 20400) , and the Point <br /> of Compliance and all Monitoring Points (under § 20405) . This Water Standard shall apply during the active life of the <br /> Unit, the closure period , the post-closure maintenance period , and during any compliance period ( under § 20410) . <br />
