WASTE DISCHARGE REQUIREMENTS ORDER R5-2015-0058-01 -4- <br />SAN JOAQUIN COUNTY DEPARTMENT OF PUBLIC WORKS <br />FOOTHILL SANITARY LANDFILL, INC. <br />FOOTHILL LANDFILL <br />SAN JOAQUIN COUNTY <br /> <br />11. On 9 October 1991, the United States Environmental Protection Agency (USEPA) <br />promulgated MSW landfill regulations under the Resource Conservation and <br />Recovery Act (RCRA) known as “Subtitle D” (Code of Federal Regulations, title 40, <br />part 258). Subtitle D applies to all California unclassified, Class II and III landfills that <br />ever accepted MSW and any waste on or after the effective date of Subtitle D (9 <br />October 1991). Limited exceptions to the applicability of Subtitle D regulations <br />include (but are not limited to) <br />a. MSW landfills that ceased accepting wastes prior to the federal deadline may <br />only be required to comply with the closure/postclosure requirements in Subpart <br />F (40 CFR 258.60); and <br />b. MSW landfills constructed prior to the federal deadline may be exempt from the <br />design requirements in Subpart D (40 CFR 258.40). <br />12. State Water Resources Control Board Resolution 93-62 (as amended on 21 July <br />2005, Policy for Regulation of Municipal Solid Waste (Resolution 93-62) requires the <br />Central Valley Water Board WDRs for MSW landfills to implement the applicable <br />provisions of the federal MSW regulations that are necessary to protect water quality, <br />and in particular the containment provisions and the provisions that are either more <br />stringent or that do not exist in Title 27. See Resolution 93-62, Provision I.A. Title 27 <br />provisions applicable to MSW landfills that are equivalent to, or more stringent than, <br />corresponding Subtitle D regulations are not affected by Resolution 93-62. <br />13. LF-1’s waste footprint was established prior to the Subtitle D federal deadline, so it <br />was not required to be retrofitted with a Subtitle D composite base liner per the <br />exemption described in Finding 11.b above. The landfill accepted waste after the <br />effective date of Subtitle D, however, so it is subject to all other Subtitle D <br />requirements, as referenced in Resolution 93-62, Attachment 1. LF-2, however, is <br />subject to all of Subtitle D regulations because it accepted waste after the effective <br />date of Subtitle D and is still active. <br />14. This Order implements the applicable regulations for discharges of solid waste to land <br />through Prohibitions, Specifications, Provisions, and monitoring and reporting <br />requirements. Prohibitions, Specifications, and Provisions are listed in Sections A <br />through H of these WDRs below, and in the Standard Provisions and Reporting <br />Requirements (SPRRs) for Nonhazardous Solid Waste Discharges Regulated by <br />Subtitle D and/or Title 27 dated January 2012 which are part of this Order. Monitoring <br />and reporting requirements are included in the Monitoring and Reporting Program <br />Order (MRP) R5-2015-0058 (operative MRP) and in the SPRRs (See Finding 15). In <br />general, requirements that are either in regulations or otherwise apply to all MSW <br />landfills are considered to be “standard” and are therefore in the SPRRs. Any site- <br />specific changes to a requirement in the SPRRs are included in the applicable section <br />(Sections A through H) of these WDRs, and such requirement in the WDRs <br />supersedes the requirement in the SPRRs. <br />15. Each time the operative MRP is modified, the revised version shall become the <br />operative MRP (superseding the prior version) and be incorporated as part of this Order <br />(i.e. in lieu of the prior version).
