WASTE DISCHARGE REQUIREMENTS ORDER R5-2015-0058-01 -29- <br />SAN JOAQUIN COUNTY DEPARTMENT OF PUBLIC WORKS <br />FOOTHILL SANITARY LANDFILL, INC. <br />FOOTHILL LANDFILL <br />SAN JOAQUIN COUNTY <br /> <br />MW-3. No VOCs were detected in groundwater during the investigation. <br />126. On 30 October 2003, in response to a September 2003 California Water Code <br />Section 13267 Order issued by the Executive Officer, the Discharger submitted an <br />EFS report and a partial cover work plan (Partial Cover Workplan and the <br />Engineering Feasibility Report and Corrective Action Program, Based on the <br />Results of the Evaluation Monitoring Plan at the Foothill Sanitary Landfill, prepared <br />by San Joaquin County Department of Public Works). The EFS report attributed <br />the groundwater impacts to localized infiltration from exposed wastes along the <br />edge of the landfill near MW-3 and indicated that the issue had been resolved in <br />1998 by grading and covering the area. The EFS did not recommend any further <br />corrective action measures and did not include a work plan for closure of LF-1. <br />127. On 16 December 2003, the Executive Officer issued an Administrative Civil Liability <br />Complaint (ACLC No. R5-2003-0159) in the amount of $10,000 for failure to submit <br />the required work plan for closure of LF-1 in violation of the Section 13267 Order. <br />Subsequent negotiations resulted in a formal Settlement Agreement by which the <br />Discharger agreed to pay the $10,000 in proposed administrative civil liability and <br />accept a Cleanup and Abatement Order (CAO R5-2004-0706) implementing a Site <br />Improvement Project proposed by the Discharger to address the threat to <br />groundwater from LF-1. A revised ACL Complaint (ACLC No. R5-2004-0520) was <br />also issued acknowledging the agreement. The Executive Officer agreed to <br />recommend a modification of WDRs Order No. R5- 2003-0020 to be consistent with <br />CAO R5-2004-0706 if landfill gas releases were successfully eliminated. <br />128. The Site Improvement Project incorporated into CAO R5-2004-0706 included the <br />following components;12 <br />a. Final closure of the crest of LF-1; <br />b. Installation of an overlay barrier between Module I refuse and Module 1’s <br />expansion side slope; <br />c. Installation of partial and intermediate cover over areas of LF-1 not included <br />above; <br />d. Implementation of landfill drainage and erosion controls; <br />e. Installation of a landfill gas collection system; and <br />f. Installation of at least two additional groundwater monitoring wells. <br />CAO R5-2004-0706 required submission of various plans and reports corresponding <br />to the above tasks and specified a 1 November 2006 due date for completion of the <br />project including initiation of gas extraction. (This due date was ultimately extended <br />to 24 February 2007 to provide the Discharger time to complete installation of the <br />LFG extraction system.) <br /> <br />12.
