WASTE DISCHARGE REQUIREMENTS ORDER R5-2015-0058-01 -36- <br />SAN JOAQUIN COUNTY DEPARTMENT OF PUBLIC WORKS <br />FOOTHILL SANITARY LANDFILL, INC. <br />FOOTHILL LANDFILL <br />SAN JOAQUIN COUNTY <br /> <br />152. Title 27, section 22221 requires a cost estimate for corrective action of all known or <br />reasonably foreseeable releases. In a 20 October 2008 letter, Central Valley Water <br />Board staff approved a 30 September 2008 cost estimate of $1,677,090 in 2008 <br />dollars submitted by the Discharger for corrective action of all known or reasonably <br />foreseeable releases at the landfill. The approved cost estimate included the costs of <br />installing four deep landfill gas extraction wells extending to the base of LF-1 to <br />address a hypothetical gas release at unlined Module I (i.e., LF-1). On 30 January <br />2009, CalRecycle approved a Pledge of Revenue Agreement (Resolution R-08-686) <br />per Title 27, section 22245 as the mechanism for corrective action financial <br />assurances the site. This Order requires that the Discharger maintain financial <br />assurance with the CalRecycle in at least the amount of this cost estimate, as <br />adjusted annually for inflation. As of 2014, the balance of the corrective action fund <br />was $61,607. <br />153. On 31 July 2020, the Discharger submitted a Joint Technical Document (JTD) to <br />CalRecycle for the Facility. The JTD included the Preliminary Closure and Post- <br />Closure Maintenance Plans (Preliminary CPMP). On 30 April 2021, the Discharger <br />submitted an update to the Post-Closure Operations and Maintenance Cost <br />Estimates. CalRecycle approved the Preliminary CPMP on 12 April 2022. However, <br />the Preliminary CPMP does not include post-closure cost estimates for Class II <br />Calaveras SI unit. This Order requires submittal of a Preliminary CPMP for Calaveras <br />SI, including post-closure cost estimates and financial assurance mechanism update, <br />as specified in Financial Requirements section F and Provision H.9.i. <br />CEQA AND OTHER CONSIDERATIONS <br />154. The action to revise waste discharge requirements for this existing facility is exempt <br />from the provisions of the California Environmental Quality Act (CEQA), Public <br />Resource Code section 21000, et seq., and the CEQA guidelines, in accordance with <br />Title 14, section 15301. <br />155. This Order implements: <br />a. The Water Quality Control Plan for the Sacramento River and San Joaquin River <br />Basins, Fourth Edition; <br />b. The prescriptive standards and performance goals of California Code of <br />Regulations, title 27, section 20005 et seq., effective 18 July 1997, and <br />subsequent revisions; <br />c. State Water Board Resolution 93-62, Policy for Regulation of Discharges of <br />Municipal Solid Waste, adopted 17 June 1993, and revised on 21 July 2005. <br />d. The applicable provisions of Title 40 C.F.R. section 258 “Subtitle D” federal <br />regulations as required by State Water Board Resolution 93-62. <br />
