<br />STANDARD PROVISIONS AND REPORTING REQUIREMENTS, JANUARY 2012 - 26 - <br />FOR WASTE DISCHARGE REQUIREMENTS <br />FOR DISCHARGES REGULATED BY SUBTITLE D AND/OR TITLE 27 <br /> <br /> <br />1. Measurably Significant Evidence of a Release Has Been Confirmed. If the <br />Discharger has confirmed that there is measurably significant evidence of a <br />release from a waste management unit pursuant to Standard Monitoring <br />Specification I.46 or I.47, then the Discharger shall: <br /> <br />a. Immediately sample all monitoring points in the affected medium at that <br />waste management unit and determine the concentration of all monitoring <br />parameters and constituents of concern for comparison with established <br />concentration limits. Because this constituent of concern scan does not <br />involve statistical testing, the Discharger will need to collect and analyze <br />only a single water sample from each monitoring point in the affected <br />medium [Title 27, § 20420(k)(1)]. <br /> <br />b. Within 14 days of confirming measurably significant evidence of a release, <br />the Discharger shall (for releases from MSW landfill units) notify all persons <br />who own the land or reside on the land that directly overlies any portion of <br />the plume of contamination if contaminants have migrated off-site if <br />indicated by sampling of detection monitoring wells [40 C.F.R. <br />§ 258.55(g)(1)(iii)]. <br /> <br />c. Within 90 days of confirming measurably significant evidence of a release, <br />the Discharger shall submit an amended report of waste discharge to <br />establish an Evaluation Monitoring Program meeting the requirements of <br />Title 27, sections 20420(k)(5)(A-D), including but not limited to the results <br />of sampling pursuant to paragraph J.1.a, above. The Evaluation Monitoring <br />Program shall be designed for the collection and analysis of all data <br />necessary to assess the nature and extent of the release and to determine <br />the spatial distribution and concentration of each constituent throughout the <br />zone affected by the release [Title 27, § 20420(k)(5) and § 20425(b)]. For <br />releases from MSW landfill units, the Evaluation Monitoring Program shall <br />also include any additional proposals necessary to comply with 40 C.F.R. <br />§ 258.55, particularly the additional monitoring well required by 40 C.F.R. <br />§ 258.55(g)(1)(ii). <br /> <br />d. Within 180 days of confirming measurably significant evidence of a <br />release, the Discharger shall submit to the Central Valley Water Board an <br />initial engineering feasibility study for a Corrective Action Program <br />necessary to meet the requirements of Title 27, section 20430. At a <br />minimum, the initial engineering feasibility study shall contain a detailed <br />description of the corrective action measures that could be taken to achieve <br />background concentrations for all constituents of concern [Title 27, <br />§ 20420(k)(6)]. <br /> <br />e. If the Discharger confirms that there is measurably significant evidence of a <br />release from the waste management unit at any monitoring point, the
