Tiered Permitting Program Inspection Report <br />Date: <br />December 8, 2025 <br />Facility Address: <br />2112 E Louise AVE, LathropLATHROP WATER TREATMENT FACILITY / COR <br />Facility Name: <br />Environmental Health Department <br />8 22 CCR 45 67450.13(a)(2) 3210028-Inflation adjustment to the Closure Cost Estimate was completed by March 1 of <br />each year <br />OBSERVATION: This facility is treating hazardous waste but has not submitted by March 1 an inflation adjusted written <br />estimate of the cost using an inflation factor derived from the annual Implicit Price Deflator for Gross National Product as <br />published by the U.S. Department of Commerce in its Survey of Current Business. <br />REGULATION GUIDANCE: The owner or operator of a fixed treatment unit (FTU) shall adjust the closure cost estimate <br />to close each unit every year by March 1. The adjustment shall be made as specified in subsections (a)(2)(A) and (a)(2) <br />(B) of this section, using an inflation factor derived from the annual Implicit Price Deflator for Gross National Product as <br />published by the U.S. Department of Commerce in its Survey of Current Business. The inflation factor is the result of <br />dividing the latest published annual Deflator by the Deflator of the previous year. (A) The first adjustment is made by <br />multiplying the closure cost estimate by the inflation factor. The result is the adjusted closure cost estimate. (B) <br />Subsequent adjustments are made by multiplying the latest adjusted closure cost estimate by the latest inflation factor. <br />This adjusted closure cost estimate shall be submitted to the California Environmental Reporting System (CERS) <br />website. California Health & Safety Code section 67450.13 describes the financial assurance mechanisms and <br />exemptions. <br />CORRECTIVE ACTION: Immediately submit the required adjusted closure cost estimate for the FTU to CERS for review <br />by the San Joaquin County Environmental Health Department (EHD). Provide a corrective action statement and <br />supporting documentation to the EHD within 30 days. <br />This is a (Class 2) Violation. <br />20 22 CCR 45 67450.3(c)(8) 3210010-Documents for operating a FTU are maintained onsite <br />OBSERVATION 1: The facility was unable to demonstrate that they have developed and follow a written waste analysis <br />plan in accordance with CCR 66265.13(b), which, at a minimum specifies <br />-The parameters for which each hazardous or non-hazardous waste will be analyzed and the rationale for the selection of <br />these parameters. <br />-The test methods to be used to test for these parameters. <br />-The sampling and sampling management methods which will be used to obtain a representative sample of the waste to <br />be analyzed. <br />-The frequency with which the initial analysis of the waste will be reviewed or repeated to ensure that the analysis is <br />accurate and up to date. <br />OBSERVATION 2: The facility could not demonstrate that training was provided for facility personnel to perform their <br />duties in a way that ensures the facility's compliance with the requirements of CCR 66265.16. This includes maintaining <br />employee-signed or -certified records that document that the training required has been given to, and completed by, each <br />employee. <br />REGULATION GUIDANCE: Maintain the documents specified below at the facility where the FTU is operating. The <br />owner or operator shall make these documents available upon demand at the facility to the San Joaquin County <br />Environmental Health Department (EHD). A copy of these documents shall be delivered in person or by certified mail <br />with return receipt requested to the EHD when requested in writing by the EHD. The request from the EHD shall specify <br />the documents which are required, where and how to submit the required documents and the date by which the <br />documents shall be submitted. The documents include: <br />(A) A waste analysis plan for the treatment operation as specified in section 66265.13(b) <br />(Continued in Overall Inspection Comments section at the bottom of the report) <br />This is a (Minor) Violation. <br />1868 E.
