The business plan was submitted late on 2/15/2023. The business plan was submitted on time for the years of 2024 and 2025. This violation has been corrected. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is a (Class 2) Violation. 12 CA Health and Safety Code 25505(a)(3) 1010010 - Electronically submitted adequate response plan/procedures for release/threatened release of hazmat OBSERVATION: The emergency response(ER) procedures were missing emergency response procedures for a release or threatened release of hazardous materials, including, but not limited to, the following: - immediate notification of local emergency personnel and the Environmental Health Department (EHD) - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment - evacuation plans and procedures, including immediate notice, for the site. Add the missing elements to the ER plan. This violation has been corrected. REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a release or threatened release of hazardous materials, including, but not limited to, the following: - immediate notification of local emergency personnel and the Environmental Health Department (EHD) - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment - evacuation plans and procedures, including immediate notice, for the site.
