The business plan was submitted late on 2/15/2023. <br />The business plan was submitted on time for the years of 2024 and 2025. This violation has been corrected. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year <br />and may be submitted beginning November 1 of the previous year CORRECTIVE ACTION: Submit a statement to SJC <br />EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. <br />This is a (Class 2) Violation. <br />12 <br />CA Health and Safety Code 25505(a)(3) 1010010 - Electronically submitted adequate response plan/procedures for <br />release/threatened release of hazmat <br />OBSERVATION: The emergency response(ER) procedures were missing emergency response procedures for a <br />release or threatened release of hazardous materials, including, but not limited to, the following: - immediate notification <br />of local emergency personnel and the Environmental Health Department (EHD) - procedures for the mitigation of a <br />release or threatened release to minimize any potential harm or damage to persons, property, or the environment - <br />evacuation plans and procedures, including immediate notice, for the site. Add the missing elements to the ER plan.
