I <br /> RESTRICTED MATERIALS PERMIT#39-26-3904333 Page 12 of 15 <br /> MANNA RANCH INC Expires: 12/31/2026 <br /> NOTICE OF INTENTS <br /> Pursuant to Title 3 of the California Code of Regulations, Section 6434, the following requirements apply to the submission of <br /> Notices of Intent(NOls)for the use of California Restricted Materials within San Joaquin County. Effective February 24, 2025, <br /> all agricultural use NOls must be received electronically via www.CalAgPermits.org. No other submission methods will be <br /> accepted unless a hardship exemption has been formally granted by the County Agricultural Commissioner's office.The <br /> permittee and the licensed applicator are responsible for ensuring that a compliant NOI is submitted for each intended use of a <br /> California Restricted Material. <br /> GENERAL NOI SUBMISSION CRITERIA <br /> Non-Fumigant Restricted Materials: <br /> NOls must be submitted no less than 24 hours prior to the intended application of any California Restricted Material. For <br /> applications scheduled on Saturday afternoon, Sunday,or before 12:00 PM on Monday, NOls must be submitted by 12:00 PM <br /> on the preceding Friday. <br /> Soil Fumigants: <br /> NOls for fumigants that are introduced into the soil must be submitted at least 48 hours prior to the scheduled fumigation. The <br /> NOI for a soil fumigation taking place on a Monday must be submitted no later than the preceding Thursday. <br /> Holidays: <br /> If a pesticide application is scheduled to occur on a San Joaquin County-recognized holiday, the corresponding Notice of Intent <br /> (NOI)must be received by the County Agricultural Commissioner's office no later than 12:00 PM on the last business day <br /> preceding the holiday, and in accordance with the minimum advance submission time required for approval. (e.g., 24 or 48 <br /> hours prior to application) <br /> Time Specific NOls: <br /> Notices of intent must be time specific. Pesticide applications may begin within 4 calendar days of the intended application <br /> date listed on the NOI, only if delayed by uncontrollable conditions (e.g., adverse weather,equipment unavailability). Once <br /> started, the application must be completed within the next 3 calendar days;otherwise, a new NOI is required. <br /> NOI Waiver Requirement: <br /> If a NOI is submitted less than the hours specified in regulation or these permit conditions, a waiver must be issued by a <br /> licensed Agricultural Biologist in the Agricultural Commissioner's office.The NOI must be clearly marked as"NOI WAIVER"and <br /> state the reasoning for the waiver request. NOI waiver requests are limited to critical situations where immediate control <br /> measures are needed to prevent substantial economic loss. Requests will be approved or denied at the Commissioner's <br /> discretion. <br /> Resubmittal Requirement: <br /> If the application does not occur within the 4-day window, the permittee or applicator must submit a new NOI to the Agricultural <br /> Commissioner. The new NOI must be clearly marked as"RESUBMITTAL"or"DATE CHANGE." <br /> Cancellation Notice: <br /> If the application of a restricted material is cancelled, the permittee or applicator must promptly notify the Agricultural <br /> Commissioner's office and request a withdrawal of the Notice of Intent or follow criteria for resubmittal. <br /> APPLICATIONS OF RESTRICTED MATERIALS <br /> 1.Applicators shall comply with all applicable laws, regulations, label directions, and any more restrictive conditions specified in <br /> this permit. Unless otherwise specified by label, law, regulation, permit,or site-specific environmental conditions, maximum <br /> wind speed for applications of California Restricted Materials shall be determined using an anemometer positioned four feet <br /> above ground level and shall not exceed the following: <br /> a. Spray- 10 m.p.h. <br /> b. Dust-8 m.p.h. <br /> c. Pellets, granules or baits- 16 m.p.h. <br /> 2. Unless specifically named as a dust on this permit or exempt by regulation, NO DUST FORMULATIONS are allowed. <br /> 3.Apply pesticides covered by a Section 18 in conformance with the Section 18 directions.The Section 18 directions must be <br />
