OBSERVATION:The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS)annually by the due date, January 15. Business plan was submitted late on 2/18/2023 for the facility and inventory sections for the year of 2023, The plans section was submitted late on 12/29/2023 for the year of 2023. The business plan was submitted on time for the years of 2024 and 2025. This violation was corrected. REGULATION GUIDANCE:The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is a repeat violation (Class 2)Violation. 10 CA Health and Safety Code 25505(a)(1) 1010004-Complete and accurate Hazardous Materials Inventory information electronically submitted. OBSERVATION:The Hazardous Materials Inventory forms for waste anti freeze,waste oil, oxygen, diesel, acetylene, and petroleum distillates were not complete. Obsolete federal hazard categories were found in the chemical fact sheets for waste anti freeze,waste oil, oxygen, diesel, acetylene, and petroleum distillates. Discard the obsolete federal hazard categories and add the new federal hazard categories using updated safety data sheets(SIDS). REGULATION GUIDANCE :The Hazardous materials inventory information must be current and submitted as part of the business plan. CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval.
