Business plan was last submitted on 8/16/2023 for the year of 2023. The business plan has not been submitted for the years of 2024 and 2025. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is a (Class 2)Violation. 10 CA Health and Safety Code 25505(a)(1) 1010004 - Complete and accurate Hazardous Materials Inventory information electronically submitted OBSERVATION: The Hazardous Materials Inventory forms for used oil were not complete. The max daily amount for used oil is listed at 110 gallons but there is eleven 55 gallon drums totaling 605 gallons. The max daily amount for used oil should be listed at 605 gallons. The oil filter have not been reported in CERS. There are seven 55 gallon drums of oil filters on site. The max daily amount for oil filters should be listed at 700 pounds. Add the oil filters to the chemical inventory in CERS. REGULATION GUIDANCE :The Hazardous materials inventory information must be current and submitted as part of the business plan. CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval.
