OBSERVATION:The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS)annually by the due date, January 15. A complete HMBP CERS submittal for 2022 was made late on 4/5/22. REGULATION GUIDANCE:The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year CORRECTIVE ACTION: Corrected onsite. submittal as made on 4/5/22 and has been submitted by January 15 annually since then. This is(Minor)Violation. 14 CA Health and Safety Code 25505(a)(4) 1020002-Provided initial and annual training and maintained training records for a minimum of three years. OBSERVATION:There were no records onsite for the last three years on HazCom Hazardous Communication training and site specific emergency action plan training as stated in the facility training program submitted to CERS.There were no records for site specific training for the last three years for the items listed below A-C. REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training.All employees shall be trained in safety procedures in the event of a release or threatened release of a hazardous material, including, but not limited to,familiarity with the following plans and procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (C)Evacuation plans and procedures, including immediate notice,for the business site. This training shall be documented electronically or by hard copy and shall be made available for a minimum of three years. CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the training records to the EHD. This is(Class 2)Violation.
