The business plan was submitted late on 2/16/2023 for the year of 2023. The business has made a submittal on time for the years of 2024 and 2025. This violation has been corrected. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is a (Class 2)Violation. 10 CA Health and Safety Code 25505(a)(1) 1010004 - Complete and accurate Hazardous Materials Inventory information electronically submitted OBSERVATION: 500 gallons of propane were found on site that have not been reported to CERS. Add the 500 gallons of propane to the chemical inventory in CERS. REGULATION GUIDANCE: Any material that meets or exceeds the reportable quantity shall be reported in the facility's business plan. CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, add the materials to the hazardous material inventory, and submit to the EHD for approval.
