OBSERVATION:The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS)annually by the due date, January 15. The business took over operations in January 1st of 2025.The business did not make a submittal for the year of 2025. Immediately make a new submittal in CERS. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is(Class 2)Violation. 5 CA Health and Safety Code 25508.1(a)-(f) 1010006-Updated within 30 days of 100% increase or new haz; change of address/owner/name; or change in ops. OBSERVATION: During the inspection, Chad Jackson stated that ownership changed since January 1 st of 2025.The business has not updated and submitted the information within 30 days in CERS. REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the information submitted to the California Environmental Reporting System (CERS): a) A 100 percent or more increase in the quantity of a previously disclosed material. b) Any handling of a previously undisclosed hazardous materials c) A change of business or facility address d)Change business ownership e)Change of business name f)(1)A substantial change in the handler's operations occurs that requires modification to any portion of the business plan. (2)For the purpose of this subdivision, "substantial change" means any change in a facility that would inhibit immediate response during an emergency by either site personnel or emergency response personnel, or that could inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, or impede implementation of the business plan. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval.
